Signer Identification & Satisfactory Evidence
Hawaii requires the notary to be satisfied of the signer's identity through personal knowledge or satisfactory evidence, and to ensure personal appearance.
Satisfactory evidence
A Hawaii notary establishes identity by personal knowledge or satisfactory evidence such as a current government-issued photo ID, or by a credible witness where allowed. The signer must personally appear before the notary. Because Hawaii ties each act to the notary's certification and journal, accurate identity determination is essential.
Refusing improper requests
If the notary cannot verify identity, doubts capacity, or believes the act is not voluntary or is fraudulent, the notary must refuse. Valid ID does not override doubts about willingness or awareness. Refusal in these circumstances protects the public and the notary.
