Arizona Real Estate License Law (ARS Title 32, Ch. 20)
Arizona real estate practice is governed by ARS Title 32, Chapter 20 and the Commissioner's Rules, administered by the Arizona Department of Real Estate (ADRE). This chapter covers ADRE's authority, the Public Report for land sales, and renewal and education requirements.
ADRE and the Commissioner
The Arizona Department of Real Estate, led by the Real Estate Commissioner, administers Title 32, Chapter 20 and the Commissioner's Rules. ADRE licenses brokers and salespersons, investigates complaints, and disciplines licensees. Other agencies such as the Corporation Commission and the Registrar of Contractors have no authority over real estate licensees.
The Public Report
A developer of subdivided or unsubdivided land must obtain a Public Report from the Commissioner and deliver it to buyers, disclosing material facts about the property. The Public Report protects buyers of new land offerings and is distinct from condition disclosures used in ordinary resales.
Renewal and Continuing Education
Arizona real estate licenses are issued for two years and require ADRE-approved continuing education, including mandatory subject areas, before renewal. Both brokers and salespersons must renew and complete CE, which keeps licensees current on Arizona law.
