The Responsible Broker and Branch Supervision

Mississippi assigns firm-level accountability to a designated 'responsible broker.' This chapter explains the responsible broker's supervisory duties, branch-office rules, and record and trust-account obligations that make broker candidates distinct from salespersons.

Who Is the Responsible Broker

Each real estate firm in Mississippi must have a responsible broker who is accountable to the Commission for the activities of the firm and of every licensee affiliated with it. The responsible broker supervises salespersons and associate brokers, ensures that advertising and transactions comply with the law, and is answerable for the firm's handling of client money. A licensee's authority to act flows from the responsible broker's active license.

Branch Offices and Advertising

A responsible broker who operates more than one office must have each branch office licensed and, as the Commission requires, supervised so that consumers are protected at every location. All advertising must be done in the name of the responsible broker or firm; a salesperson may not advertise property in the salesperson's own name alone. The responsible broker is responsible for ensuring advertising is truthful and identifies the firm.

Trust Accounts and Recordkeeping

The responsible broker must deposit earnest money and other client funds into a trust or escrow account kept separate from the broker's operating and personal funds. Commingling or converting trust money is a serious violation. The broker must keep records of all transactions and trust-account activity available for Commission inspection, and must promptly account for and disburse escrow money according to the terms of the contract or a proper release.
