Montana Broker License Law
Montana real estate practice is governed by Title 37, Chapter 51 of the Montana Code Annotated (MCA) and the rules of the Board of Realty Regulation within the Department of Labor and Industry. This chapter covers the Board's authority and the broker's role.
The Board of Realty Regulation
The Montana Board of Realty Regulation, part of the Department of Labor and Industry, licenses and regulates brokers, salespersons, and property managers under Title 37, Chapter 51 MCA and the Board's administrative rules. The Board issues licenses, adopts rules, and disciplines licensees for violations. A broker license is the higher tier that may operate a firm and supervise salespersons.
Broker vs. Salesperson
A Montana broker may operate independently, employ salespersons, and act as a supervising broker for a firm, while a salesperson must work under a supervising broker and be paid through that broker. To advance to broker, a Montana salesperson must meet experience and education requirements above the salesperson level. The broker is accountable to the Board for the firm's compliance.
Discipline and Renewal
Grounds for discipline in Montana include misrepresentation, mishandling trust funds, and violating the Board's rules or agency-disclosure requirements. Licenses must be renewed on the Board's schedule with required continuing education. The Board may deny, suspend, or revoke a license or impose other sanctions for violations of Title 37, Chapter 51 MCA.
