Nebraska Agency Disclosure and Dual Agency

Nebraska requires licensees to provide a statutory agency-disclosure pamphlet and recognizes limited dual agency through a designated broker. This chapter explains the disclosure and the recognized relationships.

The Agency Disclosure Pamphlet

Nebraska licensees must provide consumers with the statutory agency-relationships disclosure pamphlet, which explains the ways a licensee may work with a buyer or seller. The pamphlet is provided at the appropriate time so consumers understand their representation options before sharing confidential information. Providing the pamphlet is a required part of establishing a relationship with a consumer.

Recognized Relationships

Nebraska recognizes the seller's agent, the buyer's agent, dual agency, and limited-agency arrangements. A licensee may act as a limited seller's or buyer's agent with defined duties. The consumer's choice of relationship is documented so both the licensee and the consumer understand the scope of representation.

Designated Broker and Limited Dual Agency

Under Nebraska law, a designated broker may authorize dual agency or appoint affiliated licensees as limited agents for the buyer and the seller in the same transaction. When dual agency applies, the licensee must have the required consent and must not disclose one party's confidential information to the other. The designated broker is responsible for managing these relationships within the firm.
