Escrow and Trust Accounts

Client funds such as earnest money must be deposited into a properly maintained escrow or trust account, which is the managing broker's responsibility. Commingling client money with personal or operating funds, or converting it to the licensee's use, is prohibited and disciplinable.

Records and Advertising

Licensees must keep accurate transaction and disclosure records. Advertising must be truthful and not misleading and generally must identify the brokerage. Brokers advertise under their managing broker's supervision and must comply with fair housing requirements.

Professional Conduct

Indiana licensees must deal honestly with all parties, disclose known adverse material facts, avoid misrepresentation, and follow the Commission's rules. Violations, including mishandling funds or failing to disclose agency, can result in fines, suspension, or revocation.
