Designated Broker and Branch Supervision
Nebraska assigns firm-level accountability to a designated broker who supervises affiliated licensees and branch offices. This chapter covers the designated broker's supervisory duties.
The Designated Broker
Each Nebraska firm must have a designated broker who is responsible to the Commission for the firm's licensed activity and for supervising affiliated salespersons and associate brokers. The designated broker ensures the firm complies with agency disclosure, advertising, and trust-account rules. A licensee's authority flows from affiliation with the designated broker.
Branch Offices
A designated broker who operates branch offices must ensure each is properly established and supervised so consumers receive the protection of the license law at every location. The designated broker remains accountable for the conduct of licensees at each branch. Adequate supervision across locations is a core broker responsibility.
Consequences of Poor Supervision
If affiliated licensees violate the license law, the designated broker may face discipline for failing to supervise, independent of the salesperson's own liability. This accountability is why the broker tier requires additional experience and education. A designated broker should adopt policies and training to ensure firm-wide compliance.
