Outline reference: Maine-specific outline I.E "Cancellation and nonrenewal provisions" (1. Commercial lines, Ref: Chap. 39: 2908; Chap. 41: 3007; 39-A, Chap. 9: 403. 2. Personal lines, Ref: Chap. 39: 2914, 2915, 2916-A, 2920, 2921; Chap. 41: 3049, 3051, 3057; Bulletin 316), II.A "Maine Standard Fire Policy" (Ref: Chap. 41: 3002) and II.B "Hurricane deductibles" (Ref: Chap. 41: 3061, Rule 960). Section I carries 28 scored items on the combined exam and Section II (property) 2; the outline does not split I.E out.

Maine has four cancellation laws, and the exam asks which applies and how many days it requires. Each has its own notice period, new-business window (no grounds needed) and hearing deadline. Section 11.10 is the master table.

11.1 How to Read This Chapter

Source note. Statutes were read on October 13, 2026 on the Maine Legislature's statutes site (current through October 1, 2026); rules, bulletins and Bureau pages on maine.gov. Confirm any figure with the Maine Bureau of Insurance. This book is not an approved pre-licensing or continuing education course and implies no endorsement by the Bureau or Pearson VUE.

Which statute applies? Start with the line of insurance, not with the facts of the cancellation.

PolicyStatuteCommon name
Commercial casualty (commercial auto, general liability, workers' compensation, crime, professional)24-A M.R.S. 2908"commercial casualty" section
Commercial property (and any property policy outside the personal-lines scope)24-A M.R.S. 3007"commercial property" section
Personal auto24-A M.R.S. 2911-2924Maine Automobile Insurance Cancellation Control Act
Homeowners and other personal property and personal liability24-A M.R.S. 3048-3061Maine Property Insurance Cancellation Control Act

(24-A M.R.S. 2908(8), 3007(8), 3048; Bulletin 489 n.1-2.) Maine defines casualty insurance to include vehicle, liability, workers' compensation, burglary and theft, boiler and machinery and malpractice, and property insurance as insurance on real or personal property. (24-A M.R.S. 705, 707(1)) That split is why 2908 is the casualty section and 3007 the property section; the two are near mirror images.

11.2 The Words That Carry the Chapter

All four statutes share one vocabulary. The exam tests the difference between the first two terms.

  • Cancellation is termination at a date other than the expiration date. Nonrenewal is termination at the expiration date. (2908(1), 3007(1))
  • A multi-year or open-ended policy is a series of one-year terms. (2908(1)(B), 2912(2), 3048)
  • Renewal is issuing or offering a succeeding policy by the same insurer, or a certificate extending the existing policy. Transfer of a policy to an affiliate is a renewal. (2908(1)(E), 3007(1)(E), 2912(2))
  • Nonpayment of premium is failure of the named insured to discharge any premium obligation, whether due to the insurer or its agent or under a premium finance plan or extension of credit. A missed installment on a financed policy is nonpayment. (2908(1)(C), 3007(1)(C), 2912(3), 3049)

Maine law has no grace period for property or casualty premium. (Bureau auto and homeowners FAQs)

11.3 Commercial Lines: Casualty Policies (Outline I.E.1; 24-A M.R.S. 2908)

Applies to casualty contracts delivered in Maine except surplus lines, personal auto policies and assigned risk programs. (2908(8), (9))

Six permitted grounds for cancellation. Mid-term, a casualty policy can be cancelled only for one of these. (2908(2))

  1. Nonpayment of premium.
  2. Fraud or material misrepresentation in obtaining or continuing the policy or presenting a claim.
  3. Substantial change in the risk.
  4. Failure to comply with reasonable loss control recommendations.
  5. Substantial breach of contractual duties, conditions or warranties.
  6. Superintendent's determination that continuing a class of business jeopardizes the insurer's solvency.

Grounds 1 through 5 must be contained in the policy. (2908(2))

Notice of cancellation. Cancellation is not effective until notice is received, and the notice must state the effective date and the reasons. Periods and the certificate-of-mailing presumption are in Table 1; workers' compensation differs (Section 11.5). With automobile physical damage coverage, like notice goes to any loss payee. (2908(5))

Notice of nonrenewal. An extension of 90 days or less after timely notice needs no additional notice. The statute requires no reason for a commercial nonrenewal, and the Bureau says an insurer may nonrenew for any reason on timely notice, with no hearing right. (2908(5)(B); Bureau commercial cancellation/nonrenewal page; Bulletin 391 n.2) That is the line between commercial and personal lines.

Renewal on less favorable terms. If the insurer offers renewal at higher rates or less favorable terms, the new terms take effect at renewal only if the insured got 30 days' notice. Otherwise the insured may cancel the renewal within 30 days after receiving the notice, and earned premium is pro rata at the lower of the current or previous rate. It does not apply to class-wide filed rates or to increases based on a change in the risk. (2908(4))

Guaranteed premium. On a multi-year policy with a premium guaranteed for additional consideration, the insurer may not refuse to renew or raise the premium for that term. (2908(3))

New business. The grounds rule does not apply to a policy not previously renewed and in effect less than 60 days (Table 2) when notice is mailed or delivered; the insurer still must give notice. Commercial measures the window at mailing; the personal-lines acts measure at receipt. (2908(8))

11.4 Commercial Lines: Property Policies and the Standard Fire Policy Notice (Outline I.E.1; 24-A M.R.S. 3007)

Section 3007 repeats 2908 closely: the same six grounds, guaranteed-premium rule, less-favorable-renewal rule (no stated 30 days; it says notice "as required by this section"), nonrenewal period, certificate-of-mailing presumption, hearing, nonliability and 60-day new-business exception. (3007(2)-(8)) It excludes surplus lines, subchapter 5 policies and assigned risk plans. (3007(8), (9)) Three differences:

Difference 1: the cancellation notice. "To the extent that section 3002 is applicable, the notice of cancellation shall be given as provided for in that section." If 3002 does not apply, cancellation is not effective before 10 days after receipt and the notice states the effective date and reasons. (3007(5)(A)) The standard fire policy allows company cancellation on ten days' notice (Section 11.11), not the twenty of the homeowners act.

Difference 2: affiliate transfer. The insured must receive notice of less favorable changes before the renewal date of a policy transferred to an affiliate. (3007(5)(B))

Difference 3: nonpayment on fire policies. An insurer on the standard form may cancel for nonpayment without tendering a ratable proportion of premium if the premium has not been paid to the insurer, its agent or a licensed broker through whom the contract was negotiated. (3005)

Which property policies are commercial? The statute does not use the phrase. A property policy outside subchapter 5's scope (a camp rented to vacationers, a mill, a lobster wharf, a four-plex the owner does not live in) falls to 3007. This is a reading of the scope sections.

11.5 Workers' Compensation Cancellation (Outline I.E.1; 39-A M.R.S. 403)

Section 2908(5)(A) sends workers' compensation to 39-A M.R.S. 403(1): the policy may not be cancelled before its stated expiration until at least 30 days after the insurer mails notice to the Workers' Compensation Board and to the employer. If replacement insurance takes effect sooner, cancellation takes effect on the replacement's effective date. (39-A M.R.S. 403(1)) The 30 days run from mailing, to both recipients, and the commercial 10-day rule does not apply. Only subsection 1 of 403 deals with cancellation.

11.6 Personal Lines: Automobile (Outline I.E.2; the Maine Automobile Insurance Cancellation Control Act, 24-A M.R.S. 2911-2924)

Scope (2912, 2913)

The Act covers an automobile policy insuring one individual or related household residents, and only (a) private passenger or station wagon type vehicles not used as public conveyances or rented to others, and (b) other 4-wheel vehicles with a load capacity of 1,500 pounds or less not used in business. (2912(1)) It does not apply to assigned risk plan policies, garage and repair operations, a policy insuring more than four automobiles, or one issued principally for personal or premises liability. (2913) A Bangor contractor's six-pickup fleet is in 2908.

Cancellation: four grounds (2914)

A notice of cancellation is effective only if based on one of four reasons. (2914)

  1. Nonpayment of premium (not effective unless deemed received after the premium due date).
  2. Fraud or material misrepresentation affecting the policy or a claim.
  3. Violation of terms or conditions of the policy.
  4. License suspension or revocation of the named insured or an operator in the household or customary operator, during the policy term or, on a renewal, during the 180 days before its effective date. First and second suspensions under 29-A M.R.S. 2471(2) or 2472(2) and under 28-A M.R.S. 2052 are excluded. (2914(4))

Notice of cancellation (2915) and the 60-day rule

Periods are in Table 1. The reason must accompany the notice, with notice of the hearing right (2920), unless the policy has been in effect less than 60 days; a loss payee on physical damage coverage gets like notice. (2915)

Sections 2914 and 2920 do not apply to a policy or coverage in effect less than 60 days at the time the notice is received. The insurer needs no ground and there is no hearing, but 2915 notice is not excluded, so on the text notice is still required (a reading; confirm with the Bureau).

Nonrenewal (2916-A, 2917)

Auto nonrenewal is the sharp contrast with commercial nonrenewal: it needs a reason.

  • A nonrenewal notice may not issue unless based on a reason for which the policy could have been cancelled or on one of the following that occurred in the 36 months preceding the yearly anniversary date. A nonrenewal is effective only on the policy's yearly anniversary date. (2916-A)
  • Convictions of the named insured or a household or customary operator, including operating while intoxicated and speeding or reckless driving on 3 or more occasions (full list in 2916-A(1)).
  • Accidents: 2 or more accidents above the reportable threshold in 29-A M.R.S. 2251(1), not counting those where the vehicle was struck from the rear or while parked. Each additional insured vehicle in the household raises the number needed by one. (2916-A(2))
  • Insurability: a material change making the vehicle uninsurable; if for physical damage only, the insurer must offer to renew without physical damage coverage. (2916-A(3))
  • Notice (2917): see Table 1. The reason must accompany the notice and be explicit; "underwriting reasons," "loss record," "credit report" and similar terms are not by themselves acceptable.
  • Exceptions (2917): no notice is needed if the insurer has manifested willingness to renew, the insured fails to pay a premium due, or the policy is transferred to an affiliate (with notice of less favorable changes).

Other personal auto rules

  • Age (2916): no cancellation, nonrenewal or higher premium for the sole reason of a driver's age.
  • Alternate coverage notice (2921): when liability coverage is cancelled or not renewed other than for nonpayment, the notice must mention the Maine Automobile Insurance Plan.
  • Duplicate coverage (2918): a second policy with equal or more extensive coverage on the same vehicle lets the first end by nonrenewal. Renewal is not a waiver of earlier grounds (2919).
  • Excluded driver endorsement (2916-B): to avoid cancellation or nonrenewal, a signed endorsement may exclude a covered person whose conduct would support it. It must carry a conspicuous warning about liability for an excluded person under 18, name a specific individual, and be filed and approved by the Bureau. (Bulletin 491; 29-A M.R.S. 1601(10)) See Chapter 12.
  • Renewal premium reminder (2924): if no payment is received 15 days before expiration, written notice is due at least 10 days before expiration.

11.7 Personal Lines: Homeowners and Other Personal Property (Outline I.E.2; the Maine Property Insurance Cancellation Control Act, 24-A M.R.S. 3048-3061)

Scope (3048)

The act covers policies other than automobile and workers' compensation insuring (1) real property used solely for residential purposes, with not more than 4 apartments, and owner-occupied; (2) personal property of natural persons resident in that kind of property (not property used in a commercial or industrial enterprise); or (3) legal liability of a natural person, other than a policy primarily insuring commercial or industrial risks. The Bureau applies it to homeowners, renters and personal umbrella policies.

Cancellation: eleven grounds (3049)

A notice of cancellation is effective only if based on one of these paragraphs; the Bureau's FAQ list omits violation of terms. (3049)

  1. Nonpayment of premium, including additional premium justified by a physical change or change in occupancy or use.
  2. Conviction of the named insured of a crime that increases a hazard insured against.
  3. Fraud or material misrepresentation in obtaining the insurance or pursuing a claim.
  4. Discovery of negligent acts substantially increasing a hazard, or of a material nondisclosure in the application.
  5. Violation of terms or conditions (3049(4-A)).
  6. Physical changes making the property uninsurable.
  7. Property vacant with no custodial care.
  8. A trampoline remaining 30 or more days after notice.
  9. An unfenced pool (22 M.R.S. 1631) still noncompliant 30 days after notice.
  10. A dog bite loss unless the dog is removed after notice.
  11. Failure to follow loss control recommendations within 90 days after notice.

Section 3049 does not apply to nonrenewal.

The initial underwriting period (3049)

The section does not apply to a policy or coverage in effect less than 90 days (120 for a residence expected to be unoccupied for 3 months in any 12 and not the primary residence) at the time notice is received, unless it is a renewal policy. There is no hearing inside that window. Bulletin 391 gives the same numbers. (3049; Bulletin 391 n.3)

Notice of cancellation (3050) and nonrenewal (3051)

Cancellation notice matches auto except that like notice goes to a mortgagee; periods are in Table 1. (3050) For nonrenewal, notice also goes to the mortgagee, and the reason must accompany the notice and be explicit. "Underwriting reasons," "loss record," "location of risk," "credit report" and similar terms are not by themselves acceptable. The reason must be a good faith reason related to the insurability of the property, or a ground for cancellation under 3049. The exceptions match auto. (3051)

Protections and related rules

  • Age of dwelling (3057, the outline's cited section): no cancellation or refusal to issue or renew solely because of the dwelling's age, without considering its current condition.
  • Valuation increases (3059): an increase in insured value that raises the premium may be made only at renewal, on notice at least 30 days before. It does not apply to routinely scheduled inflation increases.
  • Transfer on death deed (3049-A): the policy extends to the beneficiary; on receiving the notice of death affidavit the insurer may cancel as if the policy had been in effect less than 90 days. If no affidavit arrives within 30 days after the transferor's death, the policy is deemed cancelled as of the date of death.
