WHS Legal Duties

The shared responsibilities under Australia's model Work Health and Safety (WHS) laws, from the PCBU to individual workers.

The PCBU's primary duty

A person conducting a business or undertaking (PCBU) must ensure, so far as is reasonably practicable, the health and safety of workers and others affected by the work, including safe systems, plant, training and facilities.

Workers' duties

Workers must take reasonable care for their own and others' safety, follow reasonable safety instructions, and co-operate with WHS policies. Everyone on site shares responsibility for safety.

Rights and consultation

Workers can cease or refuse work that exposes them to a serious, imminent risk, and must tell their supervisor. PCBUs must consult workers on matters affecting their health and safety, often through health and safety representatives.
