Georgia limits impaired driving strictly and phases in privileges for young drivers through graduated licensing.
BAC limits
A driver 21 or older is legally impaired (DUI) at a blood alcohol concentration of 0.08 or higher. Drivers under 21 face a lower 0.02 limit, and commercial drivers face a 0.04 limit.
Implied consent
By driving in Georgia you consent to chemical testing for alcohol or drugs when lawfully requested. Refusing a lawful test can lead to suspension of your driving privileges, separate from any DUI charge.
Joshua's Law and graduated licensing
Under Joshua's Law, 16-year-olds must complete an approved driver education course and supervised driving before licensing. A Class D provisional license carries nighttime driving limits and passenger restrictions until the driver meets age and experience requirements.
