Idaho Personal Lines Law & Coverage Rules
This chapter covers the Idaho-specific personal lines rules that sit on top of the shared national property & casualty fundamentals: who regulates insurance in Idaho, the minimum auto liability limits drivers must carry, how liability and uninsured-motorist coverage work, and the notice rules that govern cancellation and nonrenewal of personal auto and homeowners policies. Grounded figures below were checked against Idaho statute and the Idaho Department of Insurance this session; always confirm current numbers with the department before advising a client.
The Idaho Department of Insurance
Insurance in Idaho is regulated at the state level by the Idaho Department of Insurance, led by a Director. The department licenses producers, reviews policy forms and rates, investigates complaints, and enforces the state insurance code. There is no federal insurance department, so it is Idaho's own regulator, not a bank or a federal body, that oversees personal lines. Official site: https://doi.idaho.gov/.
Minimum Auto Liability Limits (25/50/15)
To satisfy Idaho's proof of financial responsibility, a personal auto policy must provide at least $25,000 bodily injury per person, $50,000 bodily injury per accident, and $15,000 property damage, written 25/50/15. These are minimums under Idaho Code sec. 49-117 (with the bond alternative in sec. 49-1229) and producers should explain that higher limits better protect the insured's assets. Because required limits can change, verify the current figures with the Idaho Department of Insurance.
Liability, UM/UIM, and the Fault System
Whether a state resolves auto claims through a traditional at-fault (tort) framework or a no-fault/PIP framework is set by state law, and it drives how much weight liability limits carry. Insurers generally must make uninsured/underinsured motorist (UM/UIM) coverage available, which the insured may accept, reject, or adjust, usually with a signed election. UM/UIM fills the gap when the responsible driver is uninsured or underinsured. Confirm Idaho's current fault framework and UM/UIM rules with the Idaho Department of Insurance.
Cancellation and Nonrenewal Notice
State law limits the reasons an insurer may cancel a personal auto or homeowners policy mid-term (for example nonpayment of premium or material misrepresentation) and requires advance written notice of cancellation or nonrenewal to the insured. The exact number of days depends on the reason and the line of business, so do not memorize a single number; verify the current Idaho notice periods directly with the Idaho Department of Insurance.
