Alcohol, Drugs & the Graduated License
Impaired driving is a crime in Mississippi, and new drivers earn privileges in stages. Knowing these limits protects your license and everyone on the road.
Adult BAC limit
A driver 21 or older is legally impaired at a blood alcohol concentration of 0.08 percent. You can still be charged at a lower level if your driving is affected by alcohol or drugs.
Zero tolerance for under 21
Drivers under 21 face a lower limit of 0.02 percent BAC. Any measurable alcohol can lead to a DUI charge and loss of driving privileges for a young driver.
Graduated licensing
Mississippi issues a learner (temporary) permit at age 15, followed by an intermediate license after a supervised holding period, and then a regular license. Intermediate drivers face nighttime and other restrictions as they gain experience.
