Electronic & Remote Online Notarization

New York authorizes electronic and remote online notarization under Executive Law and Department of State rules, with technology, identity-proofing, and recording requirements.

Remote online notarization requirements

New York permits remote online notarization by commissioned notaries who register the capability with the Department of State. RON requires communication technology allowing real-time audio-video, identity verification (such as credential analysis and identity proofing or personal knowledge), and a tamper-evident electronic signature and seal information.

Recording and retention

For remote notarizations the notary must create and retain an audio-video recording of the act and keep a record/journal, for the retention period set by New York law. These recording and journaling duties are mandatory for electronic/remote acts, unlike optional journaling for traditional paper acts.
