Commission, Bond, and the Exam

Qualifying for and keeping a Utah commission: eligibility, the surety bond, the four-year term, and the high-threshold open-book exam.

Eligibility and term

Utah sets basic qualifications and a fixed term the notary must renew.

An applicant must be at least 18 and lawfully in the United States.
The applicant must be able to read and write English.
The applicant must reside in Utah or maintain a primary place of employment or practice in Utah.
The commission is valid for four years.

The surety bond

A bond protects the public and differs for remote notaries.

A traditional notary must maintain a $5,000 surety bond.
A remote online notary must maintain a $10,000 surety bond.
The bond protects the public; the notary must repay claims paid by the surety.

The exam

Utah's open-book exam still sets a demanding pass line.

The exam has 35 questions worth 65 points and is taken open-book online.
The passing threshold is 61 of 65 points, about 94%.
It applies to both new and renewing notaries.
A high pass line means open-book success still requires studying the handbook.
