Alcohol, Drugs & the Provisional License
Impaired driving is a serious crime in Oregon, and new drivers face added limits while they gain experience. Knowing these rules protects your license and your safety.
Impaired driving limits
A driver 21 or older is legally impaired at 0.08 percent BAC. Oregon's zero-tolerance law makes it illegal for a driver under 21 to drive with any amount of alcohol.
Implied Consent
By driving in Oregon you agree to take a breath, blood, or urine test if lawfully arrested for DUII, and refusing brings an automatic license suspension.
Provisional license
In the first year, provisional drivers under 18 may not drive from midnight to 5 a.m. except in limited cases, may carry no passengers under 20 who are not immediate family in the first 6 months, and no more than three in the second 6 months. Confirm current rules with Oregon DMV.
