Arizona sets clear rules on how licensees may advertise property and services. This chapter explains the broker identification requirement, prohibitions on misleading advertising, and special rules for online and team marketing.
Broker Identification
Arizona advertising rules require that real estate advertising identify the employing broker by the name under which the broker is licensed. A salesperson cannot advertise a listing as if acting independently, because the broker is responsible for all advertising by licensees. Including the broker's name ensures the public knows who stands behind the advertisement and where accountability lies.
Truthful and Non-Misleading Content
Advertising must be truthful and must not mislead consumers about price, availability, features, or the licensee's role. False or deceptive claims violate license law and can trigger discipline. Licensees should ensure that photos, descriptions, and pricing accurately reflect the property. When advertising a property, the licensee generally needs the owner's authorization to market it.
Online, Team, and Social Media Advertising
The same rules apply to websites, social media, and electronic ads: the employing broker must be identified, and content must not mislead. Teams and individual licensees must not create the impression that they are a separate brokerage. Keeping advertising consistent with the Commissioner's Rules across all media protects consumers and keeps the licensee and broker in compliance with Arizona law.
