Money: subsection (a)

No licensee, whether acting as an agent, a transaction broker or a principal, may fail to account for and remit money belonging to others (a)(1); misappropriate or convert trust money or commingle a principal's money with the licensee's own, except that a broker may keep not more than $100 in the trust account to pay expenses of using and maintaining it (a)(2); accept, give or charge any rebate or undisclosed commission (a)(3); pay a referral fee knowing it will result in a rebate (a)(4); pay commission to an unlicensed person for licensed activity (a)(10); accept anything other than cash as earnest money unless the owner is told before accepting and the fact appears in the purchase agreement (a)(18); or fail to deposit an earnest money check or cash within five business days after all parties sign, unless all parties agree in writing on another date (a)(19).

Dealing and disclosure: subsection (a) continued

The same subsection forbids representing a broker without that broker's express knowledge and consent (a)(5), guaranteeing future resale profits (a)(6), placing a sign without the owner's or authorized agent's written consent (a)(7), offering property without the owner's knowledge and consent or on unauthorized terms (a)(8), inducing a party to break a contract (a)(9), failing to reduce financial obligations to writing and provide copies (a)(11), procuring a signature on a contract with no definite price, payment method, property description or means of fixing the closing date (a)(12), fraud or substantial misrepresentation (a)(13), misstating the sale price or terms to a lender (a)(14), failing to disclose the licensee's own interest in the property (a)(15), failing to tell the buyer when an offer is made and the seller when it is presented that closing costs must be paid and roughly how much (a)(16), failing without just cause to surrender a document to its rightful owner (a)(17), and forgery or signing for another without a power of attorney (a)(25).

Salespersons, brokers and applicants: subsections (b) to (f)

A salesperson or associate broker may not take compensation from anyone but the broker except in the narrow personal-assistant and entity cases (b)(1), must place entrusted funds in the broker's custody as soon after receipt as practicable (b)(2), may not be associated with more than one supervising broker without written consent filed with the Commission (b)(3), must disclose licensed activity to the supervising broker and not act outside that supervision (b)(5), and must submit transaction documents to the broker within 10 business days (b)(6). A broker may not pay an unlicensed person for licensed services (c)(1), fail to deliver detailed closing statements to seller and buyer and retain copies (c)(2), fail to properly supervise (c)(3), lend the broker's license or let a salesperson operate as a broker (c)(4), or fail to report advance-listing-fee disbursements to the principal every 30 days (c)(5). Subsection (e) reaches harassment, liens on residential property, impaired practice and discrimination adjudications, and subsection (f) covers fraud on the Commission and interference with its proceedings.
