Laws and Rules Affecting Oklahoma Real Estate Practice
Fifteen of the fifty items on the Oklahoma broker state portion come from this area - the largest single block. It runs from the Commission's authority through licensing, advertising, education, renewal, discipline and unlicensed activity, and its source is the Oklahoma Real Estate License Code at 59 O.S. §§ 858-101 et seq. together with the Commission's rules at OAC Title 605, Chapter 10.
The Commission and its powers
Section 858-201 re-creates a seven-member Oklahoma Real Estate Commission and makes it "the sole governmental entity, state, county or municipal, which shall have the authority to regulate and issue real estate licenses in the State of Oklahoma." Five members must be licensed brokers with five years' active brokerage experience, one is a lay person and one represents an approved school of real estate. Section 858-208 lists the powers: promulgate rules, administer examinations, issue and regulate licenses, and on a showing of good cause discipline licensees by reprimand, probation, additional education, suspension, revocation, administrative fine or any combination. Section 858-209 requires the Commission to follow the Administrative Procedures Act, and puts the burden of proof on the moving party at any hearing.
The license tiers and what each one costs to reach
The ladder runs provisional sales associate, sales associate, broker associate, broker. Ninety clock hours of basic instruction and an examination produce a provisional license (858-302), which lasts twelve months and is non-renewable unless the licensee adds forty-five clock hours of post-license education (858-102(8), OAC 605:10-3-7). A broker associate needs two years' active licensure within the previous five plus ninety clock hours of advanced instruction and an examination (858-303A). A broker needs the same two years, the same ninety advanced hours, the Broker in Charge course, and documentation of ten completed real estate transactions within the past five years (858-303). Pre-license education expires three years after the school certifies completion.
Advertising, disclosure of licensed status and unlicensed help
A broker must advertise under the registered trade name or the name the license is issued in, and the advertisement must show that the advertiser is a real estate broker rather than a private party; no advertisement may show only a post office box, telephone number or street address (OAC 605:10-9-4(a)). An associate may never advertise under the associate's name alone, and the broker's reference must be at least fifty percent or larger than any associate reference - the same test applies to team advertising. No property may be advertised without the owner's permission carrying a definite expiration date. A licensee buying or selling her own property must disclose her licensed status in writing on every transaction document and in every advertisement, and put her license number on purchase and lease contracts. A broker is responsible for all real-estate-related activity of any unlicensed assistant in the firm, and an associate who employs one is responsible in conjunction with the broker.
Renewal, notification duties and discipline
Licenses run thirty-six months, provisional licenses twelve (858-307.1), expiring at midnight on the last day of the term month; a license lapses if the renewal application and fees are not filed by then (OAC 605:10-7-2). Renewal requires thirty continuing-education hours, and for a broker those must include the fifteen-hour Broker in Charge course and six hours of Contracts and Forms. Changes of address, of association and of name are filed within ten days. A felony conviction or plea of guilty or nolo contendere must be reported in writing within thirty days of the plea and again within thirty days of judgment and sentencing (858-301.2). Section 858-312 lists twenty-eight causes for discipline, including commingling, failure to account, substantial misrepresentation, advertising without disclosing licensed status, and failure to respond to a Commission complaint within fifteen days. After revocation, no application for reissuance may be filed for five years (858-307.3), and an unlicensed person may be fined up to five thousand dollars or the commissions earned, whichever is greater, per violation (858-401).

Who regulates real estate brokers in Oklahoma?
The Oklahoma Real Estate Commission (OREC) licenses brokers, broker associates, sales associates, and provisional sales associates under 59 O.S. §§ 858-101 et seq. OREC's exams are delivered by Pearson VUE, which replaced PSI; the current Oklahoma content outline took effect April 2, 2024.
What experience do I need before the Oklahoma broker exam?
Under 59 O.S. § 858-303, a broker applicant needs two years of active licensure within the previous five years (or its equivalent) AND documentation verifying ten completed real estate transactions within the past five years, on top of 90 clock hours of advanced real estate instruction and the Broker in Charge course.
How is the Oklahoma broker exam structured?
Two separately scored portions delivered by Pearson VUE: a national portion of 80 scored items plus 5 pretest items in 150 minutes, and an Oklahoma state portion of 50 scored items plus 10 pretest items in 90 minutes. A scaled score of 75% is required on each. Salesperson candidates take a 40-item state portion and need 70% — the higher broker standard is OREC's own long-standing rule at OAC 605:10-3-5(f), not a 2024 change. Two of the six state areas, Trust Accounts and Trust Funds and Broker Management, are broker-only and account for 14 of the 50 state items.
