South Dakota Licensing Requirements

South Dakota uses a distinctive license structure in which the entry license is the Broker Associate. This chapter covers the license tiers, the education and exam path, and how licensees affiliate with a responsible broker.

The Broker Associate Entry License

South Dakota does not use a separate salesperson license. The entry-level license is the Broker Associate, who works under and is supervised by a responsible broker. This Broker Associate exam is the only South Dakota real estate license exam. Because the entry license already carries the word broker, candidates should not confuse it with the higher supervisory tier.

The Responsible Broker Tier

The Responsible Broker is the supervisory tier that operates a brokerage and is accountable for its licensees and trust accounts. A licensee reaches the Responsible Broker tier through additional education and experience, not through a separate examination. Understanding which activities require a responsible broker, and the supervisory relationship between a responsible broker and affiliated broker associates, is a core South Dakota topic.

Education, Exam, and Affiliation

To be licensed, a candidate must complete the required pre-license education, pass both portions of the licensing examination, and affiliate with a responsible broker who will supervise the new licensee. A broker associate's license is active only while affiliated with a responsible broker, and licensed activity is conducted in the name of that broker. Continuing education is required to renew.
