Mandatory Agency Disclosure
Massachusetts requires licensees to present consumers with the Mandatory Licensee-Consumer Relationship Disclosure at the first personal meeting to discuss a specific property. The form explains whether the licensee is acting as a seller's agent, buyer's agent, designated agent, dual agent, or facilitator, so the consumer understands representation before sharing confidential information.
Relationship Types Including Facilitator
Massachusetts recognizes seller agency, buyer agency, designated agency, disclosed dual agency (with consent), and the facilitator relationship. A facilitator assists both parties without representing either as a client and without owing fiduciary loyalty, though the facilitator must still act honestly and account for funds. Written consent is required for dual and designated agency.
