Missouri License Law (Chapter 339 RSMo)
Missouri real estate licensing is governed by Chapter 339 of the Revised Statutes of Missouri and administered by the Missouri Real Estate Commission (MREC). This chapter reviews who must be licensed, the broker-salesperson relationship, and conduct the Commission can discipline.
The Missouri Real Estate Commission
The Missouri Real Estate Commission, within the Division of Professional Registration, issues and regulates broker and salesperson licenses and enforces Chapter 339 RSMo and its rules. It handles applications, examinations, license renewals, and complaints, and it may investigate and discipline licensees for violations.
Broker-Salesperson Relationship
A Missouri salesperson must be licensed under and supervised by a broker and may perform brokerage activities only for that broker. Compensation for brokerage services must be paid through the salesperson's broker; a salesperson may not collect fees directly from clients or other brokers. A salesperson's license is tied to a specific broker and must be transferred when the salesperson changes affiliation.
Prohibited Conduct and Discipline
The Commission may discipline licensees for acts such as misrepresentation, fraud, commingling client funds, or other violations of Chapter 339. Handling client money improperly, practicing without an active broker, or acting outside the scope of the license can lead to fines, suspension, or revocation.
