Property Condition and Disclosures
Sellers and agents must disclose material facts and known defects. Proper disclosure protects buyers and reduces licensee liability.
State Disclosure Forms
Ohio requires most residential sellers to complete a Residential Property Disclosure Form reporting known material defects based on actual knowledge. The form is a disclosure of known conditions, not a warranty of condition. Agents must not conceal known defects.
Federal and Environmental Disclosures
Sellers and landlords of pre-1978 housing must disclose known lead-based paint hazards and provide an EPA pamphlet. Other concerns like radon, mold, or underground tanks may require disclosure. Latent (hidden) defects known to the seller generally must be disclosed.
