Transfer of Title
Title passes through deeds and other legal processes. Delivery, acceptance, and recording all play distinct roles.
Deeds and Delivery
A deed transfers title when it is delivered by the grantor and accepted by the grantee. Essential elements include a competent grantor, a named grantee, a granting clause, and a legal description. The grantor signs the deed; the grantee does not.
Recording and Title Assurance
Recording the deed gives public, constructive notice and protects against later claims, though it is not required for validity between the parties. General warranty deeds offer the most protection and quitclaim deeds the least. Title insurance protects against covered defects.
