Oklahoma License Law and the Real Estate Commission
Oklahoma real estate practice is governed by the Oklahoma Real Estate License Code and the rules of the Oklahoma Real Estate Commission (OREC). This chapter reviews the Commission's role, Oklahoma's license levels, and the Education and Recovery Fund that protects consumers.
The Oklahoma Real Estate Commission
The Oklahoma Real Estate Commission (OREC) administers and enforces the Oklahoma Real Estate License Code. It issues, renews, suspends, and revokes licenses, approves education, and investigates complaints against licensees. All persons who sell, lease, or manage real estate for others for compensation must be licensed by the Commission unless a statutory exemption applies.
License Levels: Provisional Sales Associate, Sales Associate, and Broker
Oklahoma issues most first-time licensees a 'provisional sales associate' license. Provisional sales associates must complete required post-license education within the first license period to advance to a full sales associate license. Above the sales associate is the broker, who may operate independently, supervise associates, and hold trust funds. A sales associate must always be associated with an active broker.
Education and Recovery Fund
The Oklahoma Real Estate Education and Recovery Fund reimburses members of the public who obtain a valid but unpaid court judgment against a licensee for certain violations of the license law, subject to statutory per-transaction and per-licensee limits. A licensee whose conduct triggers a payment from the fund may have their license suspended until the amount, plus interest, is repaid to the fund.
