Utah Real Estate License Law
Utah real estate practice is governed by the Real Estate Licensing and Practices Act (Utah Code Title 61, Chapter 2f) and administered by the Utah Division of Real Estate within the Department of Commerce (Utah Code Title 61, ch. 2f; the name now survives only as the chapter heading — the section that stated it, § 61-2f-101, was repealed effective 2026-05-06 by H.B. 377; checked 2026-09-09). The Division of Real Estate
The Utah Division of Real Estate, within the Department of Commerce, licenses and regulates real estate licensees under the Real Estate Licensing and Practices Act (Title 61, Chapter 2f), with policy set by the Utah Real Estate Commission. A license is required to engage in the business of real estate for others for compensation unless an exemption applies. The Division investigates complaints and may deny, suspend, or revoke a license and impose penalties.
Sales Agents and the Principal Broker
Utah calls its entry-level license a sales agent. A sales agent must be affiliated with and supervised by a principal broker and may not operate independently. The principal broker is responsible for the affiliated agents, the brokerage's real estate trust accounts, and its transaction records. A sales agent is compensated only through the affiliated principal broker.
Grounds for Discipline
The Division may discipline a licensee for conduct such as misrepresentation, dishonest or fraudulent dealing, commingling or converting trust funds, failing to make required disclosures, and violating the Act or administrative rules. Penalties can include fines, license suspension, or revocation. Mishandling client money held in trust is treated as one of the most serious violations.
