Wisconsin License Law (Chapter 452)
Wisconsin real estate licensing is governed by Chapter 452 of the Wisconsin Statutes and administered by the Real Estate Examining Board within the Department of Safety and Professional Services (DSPS). This chapter reviews license structure, supervision, and the state-approved forms.
The Examining Board and DSPS
The Real Estate Examining Board (REEB), housed in the Department of Safety and Professional Services, licenses and regulates salespersons and brokers under Chapter 452 and the REEB administrative rules. DSPS processes applications, renewals, and complaints and supports the Board's enforcement work.
Salespersons and Brokers
A Wisconsin salesperson must be associated with and supervised by a licensed broker and may provide brokerage services only through that broker, who is responsible for supervision and trust funds. Compensation flows through the broker. Brokers may operate independently and supervise salespersons.
State-Approved WB Forms
Wisconsin licensees use standardized, state-approved 'WB' forms for many transactions, such as listing contracts and offers to purchase. Using the approved forms lets licensees complete standard transactions consistently; drafting provisions beyond filling in these forms can raise unauthorized-practice-of-law concerns.
