Checking IDs and Preventing Underage Sales
Careful identification checking is the frontline defense against illegally serving minors, and it protects both the server and the establishment from serious penalties. Because underage sales are often strict-liability offenses, a server cannot rely on appearance, a guest's word, or a friendly demeanor; only valid, unexpired, government-issued photo identification confirms legal age. This chapter explains which IDs are acceptable, how to inspect them for authenticity, how to spot fake or borrowed IDs, and how to handle difficult situations calmly and consistently. Applying the same careful routine to every guest who might be underage keeps the process fair, reliable, and legally sound.
Why and When to Check ID
The purpose of checking ID is to verify that a guest is at least 21 and that the identification is genuine and current. A server should request ID any time there is reasonable doubt that a guest is of legal age, and many establishments set a policy to card everyone who appears under a certain age. Appearance alone is unreliable, so when in doubt, check.
Acceptable Forms of Identification
Acceptable identification is generally a valid, unexpired, government-issued photo ID, such as a driver's license, state ID card, passport, or military ID. Photocopies, non-photo cards, expired IDs, and a guest's spoken claim are not acceptable proof. The precise list of accepted documents can vary by state, so servers should know their local rules.
Inspecting an ID Properly
A thorough inspection means physically handling the ID rather than glancing at it, so the server can feel for alterations and examine details closely. Key checks include the birth date to confirm legal age, the expiration date to confirm validity, and the photo and physical description to confirm the ID belongs to the guest. A consistent routine makes these checks fast and reliable even during busy periods.
Detecting Fake or Borrowed IDs
Fraudulent IDs often reveal themselves through mismatched fonts, blurry or altered photos, rough or peeling edges, or information that does not match the guest. Asking the guest a question about the details on the ID, such as their zip code or middle name, can expose a borrowed card if they hesitate. Where available and lawful, ID scanners can help detect invalid or expired IDs, though they do not replace the server's visual comparison.
Handling Difficult Situations Consistently
When an ID looks suspicious or a guest becomes upset, the server should stay calm, explain that checking ID is required by law and policy, and refuse service if doubt remains. Suspected fake IDs should be handled according to the establishment's written procedure, which often includes notifying a manager. Applying the policy consistently to everyone who might be underage keeps it fair and strengthens the establishment's compliance record.
