Operating while intoxicated is a serious offense in Wisconsin, and new teen drivers earn full privileges in stages. Knowing these limits protects your license and everyone on the road.
Adult and under-21 limits
A driver 21 or older is legally impaired at 0.08 percent BAC. Under Wisconsin's absolute sobriety law, drivers under 21 must have 0.00 percent, meaning no alcohol at all while driving.
Graduated licensing
New drivers move from an instruction permit to a probationary license. Passenger and nighttime restrictions apply for the first 9 months, or until the driver turns 18 if that comes sooner.
Implied consent
By driving in Wisconsin you agree to a prohibited alcohol concentration (PAC) test after a lawful arrest. Refusing the test leads to a license revocation separate from any OWI penalty.
