The construction stormwater permit
A construction project that disturbs one acre or more of land generally requires coverage under the NPDES construction stormwater permit program before land-disturbing activity begins. The permit exists to keep sediment and pollutants out of nearby waterways during construction.
Erosion and sediment control
Along with permit coverage, a qualifying project needs an erosion and sediment control plan - measures such as silt fence, inlet protection, and stabilized entrances - to control runoff. Failing to obtain coverage or follow the plan can bring stop-work orders and penalties.
