DFS and OIR: Who Does What
Florida divides insurance oversight between two bodies. The Department of Financial Services (DFS), led by the elected Chief Financial Officer, licenses and disciplines agents through its Division of Insurance Agent and Agency Services. The Office of Insurance Regulation (OIR) regulates the insurance companies themselves, including solvency, rates, and policy forms. A common exam point is that agents are licensed by DFS, not OIR.
License Types and Qualifications
For life and health, the main licenses are the 2-15 (Life, Health and Variable Annuity), the 2-14 (Life including Variable Annuity), and the 2-40 (Health). The 2-15 is the combined credential for agents selling life, health, and variable annuity products. Applicants generally must be at least 18, be a Florida resident (for a resident license), complete required prelicensing coursework, pass the state exam, and submit fingerprints for a background check.
Appointments
As in other states, a license alone is not enough to sell for a specific company. The insurer must appoint the agent and file the appointment with DFS. Florida appointments are renewed on a recurring cycle, and an agent may hold appointments with multiple insurers. When an agent leaves a company, the appointment is terminated.
Continuing Education and Renewal
Florida licenses are maintained through continuing education. Licensees generally must complete 24 hours of CE every two years, and Florida requires a specific multi-hour Law and Ethics Update course as part of that total. Completing CE on schedule and keeping appointments current is what keeps a Florida license and its authority in force.
