Delaware Auto Coverage Requirements

Delaware pairs traditional liability limits with a mandatory personal-injury-protection benefit, so producers must understand both.

Compulsory Liability Limits

Delaware requires minimum auto liability of 25,000 dollars for bodily injury per person, 50,000 dollars per accident, and 10,000 dollars for property damage (a 25/50/10 limit). These are the state minimums; higher limits are available and usually advisable. Verify current figures with the Delaware Department of Insurance before quoting them as fixed.

Mandatory Personal Injury Protection (PIP)

Delaware requires personal injury protection (PIP) with minimum limits of 15,000 dollars for bodily injury to one person and 30,000 dollars per accident, plus 5,000 dollars for funeral expenses. PIP pays the insured's and passengers' medical and related expenses regardless of who caused the crash. These figures come from Delaware auto insurance guidance and should be reconfirmed with the state.

Add-On PIP, Not True No-Fault

Although Delaware mandates PIP that pays regardless of fault, Delaware is technically an add-on state, not a no-fault state: PIP provides first-dollar coverage, and the injured party still retains the right to pursue the at-fault driver's liability coverage for damages beyond PIP. This differs from true no-fault states that restrict lawsuits.
