Iowa P&C Insurance Law & Regulation

The Iowa supplement covers the state regulator and the consumer-protection rules layered on the national forms.

The Iowa Insurance Division

Iowa regulates the business of insurance through the Iowa Insurance Division. It licenses producers, reviews insurers for solvency and market conduct, investigates consumer complaints, and enforces the state insurance code. Know that this agency - not the motor-vehicle department - licenses P&C producers.

Unfair Trade Practices and Fiduciary Duty

Iowa's unfair-trade-practices law prohibits misrepresentation, false advertising, unfair discrimination between like risks, coercion, defamation of insurers, and unfair claim practices. Rebating - giving value not stated in the policy to induce a sale - is prohibited. Premiums a producer collects are fiduciary funds and may not be commingled or converted. The Iowa Insurance Division can fine, suspend, or revoke a license for violations.

Cancellation and Nonrenewal

Iowa law regulates cancellation and nonrenewal of personal auto and property policies, limiting mid-term cancellation of established policies to defined grounds and requiring advance written notice to the insured. Specific notice periods are set by statute and change over time; confirm the current day counts with the Iowa Insurance Division.
