Montana Auto Coverage Requirements
This chapter covers the coverage rules a Montana producer must know to place personal auto correctly: the compulsory liability limits and Montana's tort (at-fault) system.
Compulsory Liability
Montana's financial-responsibility law requires every registered motor vehicle to carry liability insurance meeting the state minimum limits, or to show an approved alternative proof of financial responsibility. The minimum bodily-injury limits are $25,000 per person and $50,000 per accident (25/50), plus a separate property-damage minimum set by state law. Because these figures can change, verify the current bodily-injury and property-damage minimums with the Montana Commissioner of Securities and Insurance.
Tort System and the Right to Sue
Montana is a tort, or at-fault, state: because it does not require no-fault PIP, an injured person keeps the full right to sue the at-fault driver for both economic and noneconomic damages, with no statutory threshold to clear before filing. Compulsory liability coverage stands behind drivers on Montana roads. Confirm the current framework with the Montana Commissioner of Securities and Insurance when advising clients.
