North Dakota Auto Coverage Requirements

This chapter covers the coverage rules a North Dakota producer must know to place personal auto correctly: the compulsory liability limits and North Dakota's no-fault system.

Compulsory Liability Limits

North Dakota's financial-responsibility law requires every registered vehicle to carry liability insurance at the state minimum limits. Per the North Dakota Insurance Department, the minimum bodily-injury limits are $25,000 per person and $50,000 per accident (25/50), plus $25,000 property damage per accident. North Dakota also requires uninsured and underinsured motorist coverage. Because these figures can change, verify the current minimums with the North Dakota Insurance Department.

No-Fault (Personal Injury Protection)

North Dakota is a no-fault state. Every auto policy must include basic no-fault, or Personal Injury Protection (PIP), coverage; the North Dakota Insurance Department states this provides $30,000 per person for economic losses such as medical expenses and work loss, paid regardless of who caused the crash. Because first-party benefits apply, the right to sue the at-fault driver for noneconomic damages such as pain and suffering is limited unless the injury meets North Dakota's statutory threshold. Confirm the current benefit amount and threshold with the North Dakota Insurance Department.
