Ohio Auto Coverage Requirements

This chapter covers the coverage rules an Ohio producer must know to place personal auto correctly: the compulsory liability limits and Ohio's tort (at-fault) system.

Compulsory Liability Limits

Ohio's financial-responsibility law requires every registered vehicle to carry liability insurance at the state minimum limits, or to show an approved alternative proof of financial responsibility. Under Ohio Revised Code 4509.51, the minimum limits are $25,000 per person and $50,000 per accident for bodily injury and $25,000 per accident for property damage (25/50/25). Because these figures can change, verify the current minimums with the Ohio Department of Insurance.

Tort System and the Right to Sue

Ohio is a tort, or at-fault, state: because it does not require no-fault PIP, an injured person keeps the full right to sue the at-fault driver for both economic and noneconomic damages. Ohio follows a modified comparative-negligence rule under which a claimant more than 50 percent at fault is barred from recovery. Compulsory liability coverage stands behind drivers on Ohio roads. Confirm the current framework with the Ohio Department of Insurance.
