North Carolina enforces impaired-driving limits strictly and phases in privileges through its Graduated Licensing System.
BAC limits
A driver 21 or older is impaired (DWI) at a blood alcohol concentration of 0.08 or higher. Drivers under 21 face zero tolerance, meaning any measurable alcohol is unlawful.
Implied consent
By driving in North Carolina you consent to chemical testing for alcohol or drugs when lawfully requested. Refusing a lawful test leads to revocation of your driving privilege, separate from any DWI charge.
Graduated licensing
Level 1 (Limited Learner Permit) requires a supervising licensed adult in the front seat at all times. Level 2 (Limited Provisional) allows unsupervised daytime driving with nighttime and passenger limits, and Level 3 grants full privileges once requirements are met.
