Alcohol, Drugs & the Graduated License

Impaired driving is a serious crime in Oklahoma, and new drivers face added limits while they gain experience. Knowing these rules protects your license and your safety.

Impaired driving limits

A driver 21 or older is legally impaired at 0.08 percent BAC. Oklahoma's zero-tolerance law makes it illegal for a driver under 21 to drive with any measurable alcohol.

Implied Consent

By driving in Oklahoma you agree to submit to a breath, blood, or other chemical test if lawfully arrested for DUI. Refusing a test brings an automatic license revocation.

Graduated Driver License

During the intermediate stage, driving is generally restricted between about 10 p.m. and 5 a.m. and limited to one non-family passenger, with exceptions such as work, school, or a licensed adult present. Confirm the current stages, ages, and hours with the Oklahoma DPS.
