Brokerage Relationships (BRRETA)
Georgia's Brokerage Relationships in Real Estate Transactions Act (BRRETA) defines the duties owed to clients and customers (O.C.G.A. § 10-6A-1 et seq.; § 10-6A-5 was amended effective 2024-07-01; checked 2026-09-09). Clients receive statutory duties including loyalty, obedience, disclosure, confidentiality, and accounting, while customers receive honesty and disclosure of material facts. Written agreements establish the relationship.
Handling Transactions
Licensees must present offers promptly, disclose material facts, and handle trust funds properly. Dual agency is permitted only with informed written consent of all parties. Proper documentation and disclosure protect both consumers and the licensee.
