Transfer of Title

Title passes through deeds and other legal means. Recording and title evidence secure the buyer's ownership.

Deeds and Warranties

A general warranty deed offers the broadest title protection, a special warranty deed covers only the grantor's period of ownership, and a quitclaim deed conveys whatever interest exists with no warranties. A valid deed requires a competent grantor, a grantee, a granting clause, a legal description, and delivery.

Recording and Title Assurance

Recording the deed gives public, constructive notice and protects against later claims. Title insurance protects against covered title defects for the owner or lender. Title can also transfer by will, intestate succession, or adverse possession.
