Chapter 1 of 340% of exam

General Property and Casualty Product Knowledge

Pearson VUE weights this area at 40% of the Texas All Lines Adjuster exam. It covers the standard fire policy, personal and commercial auto, homeowners and dwelling forms, commercial property and package policies, boiler and machinery, crime, inland and ocean marine, time-element and other additional coverages, and bonds. For worked examples, traps and full explanations, see the PrepPass Texas All Lines Adjuster Study Guide.

The standard fire policy

The standard fire policy pays the lesser of actual cash value or repair cost with like kind and quality, never more than the insured's interest. Coverage is suspended while hazard is increased within the insured's control or a building is vacant or unoccupied beyond 60 consecutive days. The insured owes prompt notice, protection of the property, an inventory and a sworn proof of loss within 60 days.

Proof of loss
Signed and sworn, within 60 days after the loss unless extended in writing (New York Insurance Law §3404 standard fire policy).
Appraisal
Each side names an appraiser within 20 days of a written demand; an award of any two sets the amount of loss, not coverage.
Texas valued policy law
A total loss by fire of insured real property is a liquidated demand for the full policy amount (Insurance Code §862.053).

Homeowners and dwelling forms

HO-2 is named-peril; HO-3 is open-peril on the dwelling and named-peril on contents; HO-4 insures a tenant's contents; HO-5 is open-peril on both; HO-6 is for condominium unit owners. A dwelling policy gives property coverage without liability and suits non-owner-occupied houses. Flood is excluded from most home policies, and coastal wind and hail coverage is often written by the Texas Windstorm Insurance Association.

Flood waiting period
Most flood policies have a 30-day waiting period (TDI).
Additional living expenses
Pays only the extra cost of living elsewhere; TDI's glossary says policies cap it at 20% of dwelling coverage.

Auto

Texas minimum liability limits are 30/60/25. Personal injury protection ($2,500 minimum per person) and uninsured/underinsured motorists coverage must be included unless rejected in writing. On a borrowed car the owner's policy is primary and the driver's own policy is excess. Business Auto Policies use covered auto symbols and usually a combined single limit.

Minimum limits
$30,000 per person, $60,000 per accident bodily injury, $25,000 property damage (Transportation Code §601.072).
UM burden
The insurer bears the burden of proving a vehicle is uninsured (Insurance Code §1952.109).

Commercial and specialty lines

Commercial property covers buildings, business personal property and property of others, on basic, broad or special causes-of-loss forms, usually with coinsurance. A Commercial Package Policy combines coverage parts; a Businessowners Policy packages property, liability and business income for small businesses. Equipment breakdown, crime, inland marine, ocean marine (general and particular average, P&I, the running-down clause), business income, ordinance or law, valuable papers, garagekeepers, umbrella and bonds fill the gaps standard forms leave.

Coinsurance
Payment = insurance carried ÷ insurance required × loss, less deductible.
General average
A voluntary sacrifice for the common safety is shared by all interests in proportion to value.
