Planning, Estimating, and California Contract Law

Planning and Estimating is the largest single section of the official CSLB C-33 outline at roughly 28 percent, and it covers evaluating job sites, selecting tools, equipment, and materials, selecting paint and finish products and colors, reading blueprints and specifications, and estimating job costs for materials, supplies, equipment, and labor. Some of these questions require computation and a calculator is provided at the test center. This chapter works through the geometry, the material and labor arithmetic, the markup and margin distinction that trips up most candidates, and the California contract rules that attach to residential painting work.

Reading the Documents Before Measuring Anything

The purpose of reviewing plans and specifications before bidding is to identify which coatings are required, how many coats, what quality level and finish, which surfaces are included, and what the specification demands in the way of submittals, mockups, and documentation. Two identical-looking buildings can carry very different paint scopes. A specification that requires product data sheets, safety data sheets, and color drawdowns as submittals before delivery adds administrative time to the job. A specification that requires temperature, humidity, and dew point to be recorded during application adds field time. A commercial contract that holds 10 percent retention until final acceptance changes the cash flow, not the price, and the contractor's planning has to carry the cost of that money until acceptance. Unit prices for additional wall area beyond the base scope are included in commercial bids so that added work has an agreed rate and does not require a renegotiation each time. Where a specification includes an allowance for wallcovering material, the painter carries the stated allowance for material and prices labor separately, so the allowance can be reconciled without disturbing the labor number. Field conditions get documented too. A painter who walks a bid on a two-story house and cannot see the rear elevation from the ground should reflect that in the estimate as a noted exclusion or an allowance until it can be inspected, rather than guessing. Photographing existing conditions before starting an exterior repaint is in the painter's own interest, because those photographs establish which damage predated the work.

Area Takeoff, Worked

Most takeoff arithmetic is rectangles and triangles. A rectangular wall 40 feet long and 9 feet high is 40 times 9, or 360 square feet. A ceiling 20 by 15 feet is 300 square feet. Gross wall area in a room is the perimeter times the ceiling height: a room 14 by 18 feet has a perimeter of 2 times (14 plus 18), which is 64 feet, and at a 9-foot ceiling that is 64 times 9, or 576 square feet before any deductions. A gable is a triangle, so its area is one half the base times the height: a gable 24 feet wide at the base rising 8 feet to the peak is 0.5 times 24 times 8, which is 96 square feet, and CSLB's own published sample question works the same way for a gable 12 feet wide by 6 feet high, giving 36 square feet. A round column is a cylinder's side surface, pi times diameter times height: a 2-foot diameter column 12 feet tall is 3.14 times 2 times 12, or about 75 square feet. Linear items convert to area by their height: 340 linear feet of baseboard averaging 6 inches high is 340 times 0.5, or 170 square feet. Both sides of a fence count: a board fence 200 feet long and 6 feet tall stained on both sides is 200 times 6 times 2, or 2,400 square feet. Deductions follow a practical rule rather than a mathematical one. Small openings such as windows and doors are frequently not deducted on exterior siding, because the extra cut-in labor around each opening offsets the area removed. Large openings are deducted, because two 12-by-14-foot overhead doors in a warehouse wall change the paintable area materially: a wall 120 by 22 feet is 2,640 square feet gross, less 2 times 168, which is 336, leaving 2,304 square feet. Where a takeoff does deduct, do it consistently: a wall 50 feet by 8 feet with one 3-by-7-foot door is 400 minus 21, or 379 square feet. One caution specific to siding: measuring lap siding as a flat rectangle understates it, because the overlapping courses and their exposed bottom edges add real surface area.

Material and Labor Arithmetic, Worked

Material is area times coats divided by spread rate, rounded up to whole containers. Four walls totaling 800 square feet at 400 square feet per gallon for two coats is 800 times 2, or 1,600, divided by 400, which is 4 gallons. A rough surface at 250 square feet per gallon needs 2,000 divided by 250, or 8 gallons per coat. Three coats over 2,700 square feet at 320 square feet per gallon is 2,700 times 3, which is 8,100, divided by 320, which is 25.3, so 26 gallons are purchased. Block filler is the trap: a 1,800 square foot concrete block wall with filler rated at about 100 square feet per gallon needs 18 gallons, roughly six times what a topcoat would need, and an estimator who budgets block filler at topcoat coverage runs out of material. Estimators also add a factor for waste and touch-up, because paint is lost to spillage, overspray, and material left in trays and equipment, and they distinguish the first coat from subsequent coats on bare porous stucco, because the first coat is absorbed and covers far less. Material cost is then straightforward: 18 gallons at 45 dollars per gallon is 810 dollars. A sundries line is added as a percentage of material cost to cover tape, plastic, caulk, sandpaper, brushes, and rollers. Labor is built on production rates. If one painter coats 150 square feet per hour and the job is 1,200 square feet for one coat, that is 1,200 divided by 150, or 8 labor-hours. The production rate must match the method: a crew spraying and back-rolling at 400 square feet per hour and a crew brushing and rolling at 150 square feet per hour on the same surface produce very different labor numbers, so the estimator has to know which method will be used. Crew days follow from total hours: 240 labor-hours with a crew of three working 8-hour days is 240 divided by 24, which is 10 working days. Preparation is estimated as a separate labor item because prep time varies enormously with condition, and pricing a repaint of a 60-year-old house using new-construction prep hours will leave the bid short. Doors are commonly priced by the unit rather than by measured area, because each door takes similar time and unit pricing captures that labor better than square footage. A stair railing with closely spaced turned balusters is priced at a much higher labor rate per foot than a plain wall of the same footprint, for the same reason in reverse.

Burdened Labor, Overhead, Markup, and Margin

Three financial ideas separate a bid that makes money from one that only looks like it does. First, burdened labor. A journeyman paid 32 dollars an hour costs the company considerably more than 32 dollars an hour, because payroll taxes, workers compensation insurance, liability insurance, and any benefits are added on top of the wage. The estimate is built on the burdened rate. Second, overhead recovery. A contractor whose yearly overhead is 120,000 dollars and who bills about 10,000 field labor hours a year recovers 120,000 divided by 10,000, which is 12 dollars per labor hour, and that figure is added to every hour bid until the year's overhead is covered. Third, and most misunderstood, markup is not margin. Markup is a percentage added to cost; margin is a percentage of the selling price. If job costs are 8,000 dollars and the contractor adds a 20 percent markup, the price is 8,000 times 1.20, which is 9,600 dollars, and the gross profit of 1,600 dollars on a 9,600 dollar price is a margin of about 16.7 percent, not 20 percent. Working the other direction, achieving a 25 percent gross margin on a job costing 12,000 dollars requires a price of 12,000 divided by 0.75, which is 16,000 dollars, not 12,000 times 1.25. A contractor who confuses the two systematically underprices every job. Two more lines belong in a complete estimate. A contingency line covers conditions that cannot be seen at bid time, such as hidden substrate damage or extra preparation discovered after demolition, and it is particularly important on an occupied-building repaint. And access, protection, and disposal are real costs: a job requiring access to a 30-foot elevation must include equipment rental, setup and takedown time, and operator training; a residential exterior surrounded by mature landscaping and a pool needs added time for protection, careful access, and daily cleanup; and a pre-1978 repaint carries lead-safe containment, cleaning, verification, and disposal as identified line items rather than as absorbed overhead.

California Contract Rules a C-33 Contractor Must Know

Several licensing law provisions apply directly to residential painting work and appear on the trade exam as well as the Law and Business exam. A written home improvement contract is required before work begins on a residential improvement project, so a California contractor who agrees to repaint a homeowner's living room for 2,800 dollars must have that agreement in writing with the content Business and Professions Code section 7159 requires. The down payment is capped: under section 7159.5, the down payment on a home improvement contract may not exceed 10 percent of the contract price or 1,000 dollars, whichever is less, so on a 9,000 dollar residential repaint the maximum down payment is 900 dollars, and progress payments thereafter must not exceed the value of work actually performed. The contract must display the down payment limit in the boldface statement the statute prescribes. Advertising is regulated too: section 7030.5 requires a licensee to include the license number in construction contracts, subcontracts, calls for bid, and all forms of advertising, which reaches vehicle signage, yard signs, business cards, and websites. The minor work exemption in section 7048 permits unlicensed work only where the aggregate contract price for labor, materials, and all other items is below the statutory threshold, which Assembly Bill 2622 raised to 1,000 dollars effective January 1, 2025, and only where the work is casual, minor, or inconsequential, does not require a building permit, is not part of a larger project, and is performed without hiring additional workers. A permit is typically needed for painting work only when the painting is part of larger permitted work rather than for the coating itself. Two practices close the chapter. When an owner asks mid-job for two additional rooms not in the original scope, the correct business step is a written change order stating the scope and the price before the work proceeds. And documenting assumptions in the written estimate, the number of coats, the level of preparation, and the surfaces excluded, defines the scope and prevents the disputes that consume a painting contractor's margin.
