State-specific supplement to the national real estate salesperson manuscript
How to use this chapter. The national chapters you have already read teach the concepts that are tested the same way in every state — agency, contracts, financing, valuation, federal fair housing, and closing math. This chapter covers only what South Dakota does differently, and it is the material that wins or loses points on the South Dakota portion of your licensing exam. Read it alongside the national text, not instead of it. A note on numbers (please read). Real estate licensing is a "your money or your life" (YMYL) subject: people make five- and six-figure decisions based on it. Throughout this chapter, the rules — does a recovery fund exist, is recording race-notice, is there a seller-disclosure form — are stable and are stated plainly. But specific numbers (education hours, fees, renewal cycles, the exam passing score) are set by administrative rule and change over time. Every changeable number in this chapter is flagged "verify current with the South Dakota Real Estate Commission." On exam day, answer with the rule; in real practice, confirm the figure with the Commission before you rely on it. Do not memorize a number from any prep book — including this one — as gospel.
1. The licensing authority: the South Dakota Real Estate Commission
Real estate licensing in South Dakota is administered by the South Dakota Real Estate Commission (often abbreviated SDREC, and referred to in this chapter as "the Commission"). It is the single state agency that issues, renews, denies, suspends, and revokes real estate licenses; approves pre-license and continuing-education courses; investigates complaints against licensees; and adopts the administrative rules that put flesh on the statutes.
The Commission's authority flows from two bodies of law, and you should be able to name both:
- The statute — SDCL Title 36, Chapter 36-21A ("Real Estate Licensing"). This is the enabling act passed by the South Dakota Legislature. It creates the Commission, defines who must be licensed, establishes license categories, and sets up the recovery fund (see Section 8).
- The administrative rules — ARSD Article 20:69 (the Commission's chapter of the Administrative Rules of South Dakota). Rules carry the detail: course-hour counts, application mechanics, trust-account handling, and standards of conduct. Because rules are easier to amend than statutes, most of the changeable numbers in this chapter live in the rules — which is exactly why they need to be verified against the current version.
The Commission is administratively housed within the South Dakota Department of Labor and Regulation (DLR), and its public information — license lookup, approved course lists, forms, and the current fee schedule — is published on the DLR real estate pages. When this chapter says "verify with the Commission," the Commission's own DLR web pages and staff are the authoritative source, not a third-party course vendor.
Exam-day takeaway: the correct answer to "who licenses and disciplines real estate agents in South Dakota?" is always the South Dakota Real Estate Commission — not the Department of Labor generally, not the Attorney General, not a local board.
2. License structure — and the entry license is Broker Associate
Here is the single most important South Dakota-specific fact in this entire chapter, and it trips up candidates who studied from generic national materials:
South Dakota does not license "salespersons." The entry-level real estate license in South Dakota is the Broker Associate license.
In most states, a newcomer earns a "salesperson" (or "sales associate") license, works under a broker, and later upgrades to "broker." South Dakota uses different nomenclature. When you finish your pre-license course and pass the exam, the credential you receive is a Broker Associate license. Everywhere the national chapters say "salesperson," read "Broker Associate" for South Dakota.
South Dakota's principal license categories are:
- Broker Associate — the entry-level license. A Broker Associate must work under, and be affiliated with, a Responsible Broker (see below). This is the license the reader of this book is studying to obtain.
- Responsible Broker — the experienced, fully independent broker who operates a brokerage, holds the firm's trust account, and supervises the Broker Associates affiliated with the firm. Every brokerage must have a Responsible Broker who is accountable for it. (You may see this described in older materials simply as "broker"; South Dakota's operative term for the supervising, firm-responsible license is Responsible Broker.)
- Broker — a broker-level licensee. In South Dakota usage, a person can hold broker qualifications while still being affiliated with (working under) a Responsible Broker rather than running their own firm.
- Additional specialized categories the Commission administers include property manager, residential rental agent, auctioneer (real estate auctions), timeshare salesperson, and registered/branch office credentials. You do not need deep detail on these for the entry exam, but you should recognize that South Dakota licenses several activity-specific categories in addition to the general brokerage ladder.
Exam-day takeaway: if a South Dakota question offers "salesperson" as an answer choice for the entry license, it is a distractor. The entry license is Broker Associate, and a Broker Associate must always be affiliated with a Responsible Broker.
3. Getting licensed: pre-license education, exam, and application
To earn a South Dakota Broker Associate license you must, in broad strokes:
- Meet the basic eligibility rules. You must be an adult and of good repute; South Dakota reviews an applicant's background and honesty (a criminal history or prior professional discipline can be grounds for denial). The Commission may require fingerprint-based background screening. Verify the current age and background requirements with the South Dakota Real Estate Commission.
- Complete the required pre-license education. South Dakota requires a Commission-approved Broker Associate pre-license course covering both national real estate principles and South Dakota license law. The course is a set number of clock hours. The number of required pre-license hours is a changeable figure — verify current with the South Dakota Real Estate Commission. (At the time of writing, prep providers advertise a roughly 116-hour Broker Associate pre-license course, but treat any specific hour count as subject to change and confirm it with the Commission.)
- Pass the licensing examination. The exam has a national portion and a South Dakota state-law portion; you must pass both. The passing score and the number/weighting of questions are changeable figures — verify current with the South Dakota Real Estate Commission (and with the Commission's testing vendor). Do not memorize a specific "you need X%" figure from any prep source.
- Submit the license application, fees, and any required proof. You apply to the Commission, pay the application/license fee, and — because a Broker Associate cannot operate independently — your license is issued in affiliation with a Responsible Broker who agrees to be responsible for your activity. All application and license fees are changeable figures — verify current with the South Dakota Real Estate Commission.
- Carry errors-and-omissions (E&O) insurance if required. South Dakota has historically required active licensees to maintain E&O coverage. Verify the current E&O requirement and any group-plan details with the South Dakota Real Estate Commission.
Post-license and continuing education
South Dakota distinguishes between the education you take before licensure and the education you must complete after you are licensed:
- Continuing education (CE) is required to renew your license each cycle. You must complete Commission-approved CE, and the Commission specifies required topics (for example, license-law/rules updates). The number of CE hours, the renewal-cycle length, and any mandatory course topics are changeable figures — verify current with the South Dakota Real Estate Commission.
- New licensees may face additional first-cycle education obligations beyond ordinary CE. Verify whether a post-license course is required of new Broker Associates, and its hour count, with the South Dakota Real Estate Commission.
Exam-day takeaway: know the sequence — approved pre-license course → pass national + state exam → apply and affiliate with a Responsible Broker → renew on time with approved CE. Know that specific hour counts, fees, and the passing score are set by rule and change; the steps do not.
4. Broker affiliation and supervision
Because the entry license is Broker Associate and not an independent credential, affiliation is a legal condition of practicing. A South Dakota Broker Associate may only conduct licensed real estate activity — listing, showing, negotiating, writing offers, handling clients — under a Responsible Broker. Key points:
- The Responsible Broker is legally accountable for the licensed acts of the associates affiliated with the firm, for the firm's advertising, and for the firm's trust/escrow account (Section 7). Supervision is not a formality; it is where liability lives.
- Compensation flows through the Responsible Broker. A Broker Associate is paid by their affiliated broker, not directly by the buyer or seller. Accepting a commission or referral fee directly from a consumer, or from another licensee outside the broker relationship, is a classic violation.
- Changing firms requires the Commission's paperwork to move your affiliation from one Responsible Broker to another; you cannot simply start working under a new broker informally. Verify the current transfer procedure and any fee with the South Dakota Real Estate Commission.
- Advertising must identify the brokerage. A Broker Associate cannot advertise as though operating an independent business.
Exam-day takeaway: every licensed act of a Broker Associate is legally the responsibility of a Responsible Broker, and money moves through that broker.
5. South Dakota agency law and the required relationship disclosure
South Dakota codifies brokerage (agency) relationships in statute (within SDCL 36-21A), and the exam tests three things: what relationships are allowed, that a written disclosure is required, and when it must be given.
The relationships South Dakota recognizes
- Seller's agent / listing agent — represents the seller.
- Buyer's agent — represents the buyer.
- Limited agent (dual agency) — South Dakota permits dual agency, but only with the informed, written consent of both the buyer and the seller. A limited agent represents both parties in the same transaction and therefore cannot advocate fully for either against the other; the licensee must keep certain confidences of each and may not disclose price or negotiating-position information without permission. Because the conflict is real, consent must be knowing and in writing.
- Designated agency — a Responsible Broker may designate one affiliated licensee to represent the seller and a different affiliated licensee to represent the buyer within the same firm, so that each consumer gets a licensee who advocates solely for them even though both work for the same brokerage. Designated agency is South Dakota's answer to the in-house dual-agency problem.
- Non-agency / transaction brokerage-type service — a licensee may in some circumstances assist parties without becoming the agent of either; the relationship must be disclosed so the consumer understands the licensee is not their advocate.
The disclosure — a rule you state affirmatively
South Dakota requires licensees to disclose their brokerage/agency relationship to consumers in writing. This is not optional and not a matter of custom — the disclosure is mandated.
- Timing: the disclosure must be made early — before the consumer discloses confidential information and before entering into a brokerage agreement or a binding contract, i.e., at the point the relationship is being formed rather than at closing. Practically, the licensee provides and reviews the relationship disclosure at or before the first substantive discussion of the consumer's specific real estate needs. The precise trigger language and any Commission form are governed by rule — confirm the current disclosure form and timing with the South Dakota Real Estate Commission — but that a written disclosure is required, and required early, is a fixed rule.
- Dual/limited and designated agency require the separate written consent described above; general disclosure of the relationship is not the same as consent to dual representation.
Exam-day takeaway: South Dakota allows dual agency (as "limited agency") and designated agency, both only with written consent, and requires an early written relationship disclosure to consumers.
6. Required property disclosures
South Dakota mandates a seller's disclosure — it is not a caveat-emptor state for residential resale
South Dakota law requires the seller of residential real property to give the buyer a completed Seller's Property Condition Disclosure Statement. This is an affirmative statutory duty (SDCL 43-4-37 through 43-4-44), not a matter of local custom, and South Dakota is therefore not a pure "buyer beware" state for covered residential sales.
Key points a licensee must know:
- Who and what is covered: the requirement applies to sales of residential real property — generally, structures of not more than four dwelling units. It applies whether the home is sold by owner or through a licensed brokerage.
- What the seller provides: a completed disclosure statement on the condition of the property (systems, structure, water, known defects, and similar). The Commission publishes a standard Seller's Property Condition Disclosure form.
- Timing: the seller must furnish the completed statement to the buyer before the buyer makes a written offer. If a material fact changes before closing, the seller must give the buyer a written amendment.
- It is a disclosure, not a warranty. The statement discloses known conditions; it does not warrant the property. It also does not relieve a licensee of the separate duty to disclose known material facts.
- Exemptions exist for certain non-typical transfers (for example, transfers by court order, foreclosure, or by a fiduciary such as an executor). These exemption categories are stable; if a specific transaction's status matters, confirm against the current statute.
Federal lead-based paint disclosure still applies
For housing built before 1978, the federal Residential Lead-Based Paint Hazard Reduction Act (Title X) applies in South Dakota exactly as it does nationwide: the seller/landlord must disclose known lead-based paint and hazards, provide any records/reports, deliver the EPA "Protect Your Family From Lead in Your Home" pamphlet, and give buyers a 10-day opportunity to conduct a lead inspection (waivable by the buyer). This is federal law layered on top of South Dakota's own disclosure statute — a licensee handling a pre-1978 home complies with both.
Exam-day takeaway: South Dakota requires a seller's property-condition disclosure for residential sales, delivered before the written offer; federal lead-paint rules apply on top for pre-1978 homes.
