This chapter is the West Virginia state-portion supplement to the national real-estate manuscript. The national chapters teach the concepts every U.S. salesperson must know — agency, contracts, financing, federal fair housing, closing math. This chapter tells you how West Virginia does it, where West Virginia departs from the national default, and which West Virginia-specific rules the state exam will test.
A word on numbers: fees, education hours, renewal cycles, tax rates, and passing scores are the parts of the law that change most often. Wherever a number appears below, treat it as "true as written but verify current with the West Virginia Real Estate Commission." The rules themselves — whether a recovery fund exists, whether West Virginia has a transfer tax, which recording act governs, what the entry license is called — are stable and are stated here affirmatively.
1. The Licensing Authority: The West Virginia Real Estate Commission
Real estate licensing in West Virginia is administered by the West Virginia Real Estate Commission (the "Commission" or "WVREC"). The Commission is the state agency that issues, renews, suspends, and revokes real estate licenses; approves pre-license and continuing-education courses and schools; sets and enforces the rules of practice; and investigates and disciplines licensees who violate the license law.
The Commission's authority flows from statute. The governing statute is the West Virginia Real Estate License Act, found at Chapter 30, Article 40 of the West Virginia Code (W. Va. Code §30-40-1 et seq.). The Commission's detailed operating rules — the ones that fill in the day-to-day mechanics the statute only outlines — are the Legislative Rules found in Title 174 of the West Virginia Code of State Rules (CSR). When the statute and the rules are read together, they form the complete body of law a West Virginia salesperson is expected to know. The Commission publishes both together each year as its "Real Estate License Act and Legislative Rules" law book; when you study, study from the current edition.
The Commission is composed of members appointed by the Governor, including licensed real-estate industry members and at least one public (consumer) member. It is funded through licensing and examination fees, which are deposited into a special state revenue account (the real estate license fund) rather than into the general fund. Commission members and staff acting in good faith within the scope of their duties are granted statutory immunity from individual civil liability — a routine but exam-worthy detail.
Exam pointer: When a question asks "who regulates real estate licensees in West Virginia?" the answer is the West Virginia Real Estate Commission — not the Attorney General, not the Secretary of State, not a national board, and not the local Association of REALTORS® (a private trade group, not a government regulator).
2. License Structure and the Entry License
West Virginia issues real-estate licenses in a two-tier structure that mirrors most states:
- Salesperson — this is the entry-level license in West Virginia. A newly licensed person enters the profession as a salesperson. A West Virginia salesperson may not operate independently: the salesperson must be affiliated with and act under the supervision of a licensed broker. This is the license this book prepares you for.
- Broker — the higher license. A broker may operate an independent brokerage, employ or affiliate salespersons and associate brokers, and hold client trust funds. Becoming a broker requires additional experience, additional education, and a separate broker examination. An associate broker is a person who holds broker qualifications but chooses to work under another broker.
West Virginia uses the traditional term "salesperson" for the entry license. It does not call the entry license an "agent," a "sales associate," or a "provisional/probationary" license the way some other states do. On the exam and on your application, the word to use is salesperson.
A related concept the exam tests is the principal broker (sometimes called the designated or responsible broker) — the individual broker who is legally responsible for a brokerage firm's operations, its trust-account compliance, and the supervision of the licensees affiliated with it. Every salesperson's license is tied to a supervising broker; you cannot hold an "unattached" active salesperson license floating free of any broker.
3. Getting Licensed: Pre-License Education, Exam, and Application
To earn a West Virginia salesperson license, an applicant generally must satisfy the following. Each number below is a moving part — confirm the current figure with the Commission — but each requirement is a stable feature of the law.
a. Basic eligibility. The applicant must be at least the minimum statutory age (verify current age minimum with the West Virginia Real Estate Commission), and must be of good moral character / trustworthiness. West Virginia requires a criminal background check as part of application; a prior conviction is not an automatic bar but is reviewed by the Commission.
b. Pre-license education. West Virginia requires the applicant to complete Commission-approved pre-license coursework before sitting for the exam. The current requirement is 90 hours of approved salesperson pre-licensing education, distributed across core subject areas (real estate principles and practices, real estate law, real estate finance, and real estate appraisal). Verify the current required hour total and the subject breakdown with the West Virginia Real Estate Commission — the hour count and its allocation are exactly the kind of number the state adjusts.
c. The licensing examination. After completing pre-license education, the applicant must pass the West Virginia salesperson licensing examination, which is administered for the Commission by a contracted testing vendor. The exam has a national (general) portion and a West Virginia state-law portion — this chapter is aimed squarely at the state portion. The number of questions, the time allowed, and the passing score are set by the Commission and its testing vendor; verify the current passing score and question counts with the West Virginia Real Estate Commission. Do not memorize a specific "pass percentage" from any third-party website as if it were fixed law.
d. Application, broker sponsorship, and fees. The applicant files a license application with the Commission, pays the required fees (verify current fee amounts with the West Virginia Real Estate Commission), and — because a salesperson cannot be active without a broker — the license is issued in connection with a supervising/sponsoring broker. West Virginia also requires proof of the required errors-and-omissions (E&O) insurance coverage to activate and maintain an active license; the state facilitates a group E&O policy that licensees may join or they may show equivalent independent coverage. Verify current E&O requirements and premium with the Commission.
4. Keeping the License: Renewal, Post-License, and Continuing Education
West Virginia real-estate licenses operate on an annual renewal cycle keyed to a fixed date. Licenses expire and must be renewed by June 30 each year; the licensee pays the renewal fee and certifies completion of the required continuing education. Verify the current renewal fee and confirm the renewal date with the West Virginia Real Estate Commission.
Continuing education (CE). To renew an active license, a West Virginia salesperson must complete Commission-approved continuing education each renewal period. The current requirement is 7 hours of approved CE per year, due by the June 30 renewal. West Virginia does not lock every one of those hours into a single mandated title — as long as the courses are Commission-approved, they count — although the Commission can and does designate required topic areas from time to time, so check whether a mandatory course (for example, an agency, law-update, or fair-housing module) is in effect for the current cycle. Verify the current CE hour total and any mandatory course topics with the West Virginia Real Estate Commission.
A practical, testable point: CE is a condition of renewal, not a suggestion. A licensee who lets the license lapse, or who renews without the required CE, is not authorized to practice; continuing to conduct brokerage activity on an expired or improperly renewed license is itself a violation. If a license lapses, reinstatement rules and possible re-examination may apply — confirm the current lapse/reinstatement window with the Commission.
5. Broker Affiliation and Supervision
This is one of the most heavily tested state concepts, and it is a bright-line rule in West Virginia.
- A salesperson must be affiliated with, and supervised by, a licensed broker. The salesperson's license authority is derivative of the broker's.
- All compensation flows through the broker. A salesperson is paid by the affiliating broker, not directly by a buyer, seller, or another brokerage. A salesperson may not accept a commission or referral fee directly from a member of the public or from a co-op brokerage; the payment must come from (or through) the salesperson's own broker.
- The salesperson cannot advertise or hold listings in the salesperson's own name. Listings belong to the brokerage, and all advertising must be done in the name of the brokerage under the broker's supervision.
- When a salesperson changes brokers, the license must be transferred to the new broker through the Commission, and the salesperson may not begin working under the new broker until that transfer is properly effected. A license does not follow the salesperson automatically.
- The principal broker is responsible for supervising affiliated licensees and for the firm's compliance, including trust-account integrity. Supervisory failure by the broker is a distinct disciplinary exposure for the broker.
Exam pointer: Any fact pattern where a salesperson takes a "thank-you" check straight from a happy seller, keeps a referral fee paid personally by another agent, or advertises a listing under only the salesperson's own name is testing this rule — and in each case the salesperson has violated West Virginia license law.
6. West Virginia Agency Law and the Required Agency Disclosure
Agency — who the licensee legally represents — is the core of both the national and state exams. West Virginia recognizes the standard agency relationships (seller's agent, buyer's agent, dual agent) and imposes specific written disclosure and consent requirements, set out in the Commission's Legislative Rules (Title 174).
The required agency disclosure. West Virginia requires the licensee to make a written disclosure of the agency relationship using the notice of agency relationship and consent form prescribed by the Commission. The rule has two timing hooks you must know:
- The form is signed by the licensee and the client at the time the agency relationship is created — that is, when the licensee begins representing that person as a client.
- Before negotiations begin, each licensee's agency form must be signed by all parties to the transaction, so that everyone in the deal knows whom each licensee represents prior to the initiation of negotiations.
The purpose is transparency: no party should be negotiating without a clear, written statement of who is on whose side. This is a disclosure requirement — it does not by itself change loyalties, it makes them visible.
Dual agency and designated agency. West Virginia permits dual agency only with informed, written consent of all parties. The rule is explicit: a licensee may not act as agent for both the buyer and the seller in the same transaction without first obtaining the written consent of both the buyer and the seller. A dual agent owes limited, balanced duties to both sides and must not advantage one client at the other's expense (for example, a dual agent must not disclose one party's bottom-line negotiating position to the other). Designated agency — where the principal broker assigns one affiliated licensee to represent the buyer and a different affiliated licensee to represent the seller within the same firm — is the common practical structure used to manage in-house dual-agency situations; it too depends on proper disclosure and consent.
Exam pointer: The West Virginia answer to "can a licensee represent both buyer and seller?" is yes — but only with the prior written consent of both. Undisclosed dual agency is prohibited and is a disciplinary offense.
7. Property-Condition Disclosure: West Virginia Is a Caveat Emptor State (Plus Federal Lead)
This is one of the sharpest state-specific distinctions, and it surprises candidates who trained on states with mandatory seller-disclosure forms.
West Virginia follows caveat emptor ("let the buyer beware") for residential property-condition disclosure. Unlike many states, West Virginia does not by statute require a residential seller to complete a standardized state seller property-condition disclosure form. The baseline common-law posture places on the buyer the duty to inspect and investigate the property's condition.
That baseline, however, is not a license to conceal, and the exam tests the limits:
- A seller may not commit fraud. A seller cannot make affirmative misrepresentations about the property and cannot actively conceal a known defect. If a buyer asks a direct question, the seller must answer truthfully.
- Latent (hidden) material defects known to the seller — dangerous conditions a reasonable inspection would not reveal — generally must not be concealed, and active concealment can create liability notwithstanding caveat emptor.
- The licensee's duty is higher than the seller's. A real-estate licensee must disclose known material defects / material facts about the property to the parties. The agent's professional duty of honesty and disclosure is a matter of license law and is not erased by the state's caveat-emptor posture toward sellers. An agent who parrots "buyer beware" while sitting on knowledge of a serious known defect is exposed to discipline.
Exam pointer: If a fact pattern says the West Virginia seller did not hand over a state disclosure form, that alone is not a violation — West Virginia does not mandate one. But if the seller lied, hid a known defect, or the agent failed to disclose a known material defect, that is actionable.
Federal lead-based paint (applies in every state, West Virginia included). For residential housing built before 1978, the federal Residential Lead-Based Paint Hazard Reduction Act (Title X) applies: the seller/landlord must (1) give the buyer/tenant the EPA pamphlet "Protect Your Family From Lead in Your Home," (2) disclose known lead-based paint and hazards and provide any records/reports, (3) include the Lead Warning Statement and disclosure language in the contract, and (4) for sales, give the buyer a 10-day opportunity to conduct a lead inspection/risk assessment (the period can be changed by mutual agreement). This federal requirement sits on top of West Virginia's caveat-emptor rule — caveat emptor does not excuse the federal lead disclosure.
