Safety & OSHA

Construction is one of the most hazardous industries, and safety is both a legal duty and a business necessity. This topic covers the employer's core safety obligations, the hierarchy of controls, and key federal OSHA requirements that apply on construction sites nationwide, such as fall protection and excavation safety.

The Employer's Duty and OSHA Basics

The federal Occupational Safety and Health Act's General Duty Clause requires employers to provide a workplace free from recognized hazards likely to cause death or serious harm. OSHA sets and enforces standards; the construction standards are found in 29 CFR Part 1926. The employer bears the primary duty to assess hazards, train workers, keep required records, and provide and require appropriate protection. Employees must follow safety rules and use provided equipment, but the core legal responsibility for a safe site rests with the employer.

The Hierarchy of Controls

When addressing a hazard, OSHA and safety professionals apply the hierarchy of controls from most to least effective: (1) elimination — remove the hazard entirely; (2) substitution — replace it with something safer; (3) engineering controls — isolate people from the hazard (guards, ventilation); (4) administrative controls — change how people work (procedures, training, signs); and (5) personal protective equipment (PPE) — the last line of defense. PPE ranks last because it depends on correct, consistent use and only reduces exposure rather than removing the hazard.

Fall Protection — the 6-Foot Rule

Falls are consistently a leading cause of construction deaths. Under 29 CFR 1926.501, workers on construction sites generally must be protected from falls of 6 feet or more to a lower level, using guardrail systems, safety nets, or personal fall-arrest systems. (In general industry the trigger is 4 feet, but on construction the 6-foot threshold applies.) Requirements also cover holes, leading edges, and work over dangerous equipment. This rule is among the most heavily cited and tested.

Excavations, PPE, and Hazard Communication

Under 29 CFR 1926.652, excavations 5 feet deep or more generally require a protective system — sloping/benching, shoring, or a trench box — unless made entirely in stable rock; protection for trenches over 20 feet deep must be engineered, and a competent person must inspect daily. Standard PPE includes hard hats, eye and hearing protection, high-visibility clothing, and proper footwear. The Hazard Communication Standard requires labeling of hazardous chemicals and access to Safety Data Sheets (SDS) so workers know the risks of the materials they handle.
