The Idaho State Law Supplement

Life, Accident and Health Insurance Producer

Everything before this chapter is national material. This is the Idaho portion of your exam — scored separately, and the section that fails more first-time candidates than any other. Idaho's insurance law lives in Title 41 of the Idaho Code; the rules implementing it live in IDAPA 18, the administrative rules of the Idaho Department of Insurance.

Two habits carry you through. Learn the structure, not just the numbers — the exam rewards knowing that Idaho has a replacement regulation and what it makes you do more than knowing a fee schedule. Treat every number as a snapshot. Dollar amounts, hour counts and filing windows are what the Legislature and the Director amend most often. A figure below that carries a dated citation was read from that source on the date shown — it was current on that date, and nothing more is claimed. A figure that still carries a bracketed verify-current flag was not confirmed from a primary source and must be checked with the Idaho Department of Insurance (doi.idaho.gov) or in the current Idaho Code and IDAPA 18 before you rely on it. Structural rules are stated flatly, because they are stable and knowable.

1. The Department of Insurance and the Director

Idaho Code § 41-201 creates the Department of Insurance as the single regulator of insurance in Idaho. Its chief executive officer is the Director (§ 41-202) — a classic trap, because national texts say "Commissioner." Section 41-203 settles it: wherever "commissioner of insurance" appears in the Idaho Code, it means the Director. On an Idaho exam, the title is Director.

The Director is appointed by the Governor for a four-year term subject to earlier removal, must be a qualified Idaho elector, and must have at least five years' practical experience in a regulated type of insurance business or comparable professional experience (Idaho Code § 41-202(2)–(3); checked 2026-09-05). The Director may delegate powers and is barred from prohibited financial interests and rewards (§§ 41-207, 41-208).

Powers (§ 41-210). The Director shall enforce the code, has the powers expressly conferred and those reasonably implied, and may conduct examinations and investigations beyond those expressly authorized to determine whether anyone has violated the code. Rulemaking (§ 41-211): reasonable rules to effectuate the code, but no rule may extend, modify or conflict with a statute; willful violation of a rule carries the same license consequences as violating the statute behind it — which is why an IDAPA 18 rule has real disciplinary teeth.

Examinations. Section 41-219 covers insurers. Section 41-220 reaches you: to ascertain compliance with law, the Director may — as often as he deems advisable — examine the accounts, records, documents and transactions of any agent, broker, solicitor, consultant, surplus line broker, general agent or adjuster. There is no fixed interval; the standard is the Director's judgment, and § 41-225 makes obstruction punishable.

Enforcement (§ 41-213). The Director may issue a cease and desist order, an order affecting a license, or an order imposing an administrative penalty, and may sue in district court, including for an injunction. Matters warranting criminal prosecution go to the Attorney General or county attorney — the Director does not prosecute crimes. Section 41-232A governs hearings on denial, nonrenewal, suspension or revocation.

2. Producer Licensing (Title 41, Chapter 10)

The requirement (§ 41-1004). No person shall sell, solicit or negotiate insurance in Idaho unless licensed for that line. Separately, no person may for a fee offer advice or opinion on any policy issuable in Idaho unless licensed for that class — with exceptions for attorneys, CPAs, qualified actuaries, persons serving only producers or authorized insurers, expert witnesses, investment advisers, and certain limited-lines licensees.

Lines (§ 41-1008(1)): Life (including endowment and annuity benefits, accidental death/dismemberment, disability income); Disability (accident and health or sickness); Property; Casualty; Variable life and variable annuity products; Personal lines; and any other line permitted by law or rule. Two Idaho points. First, the health line is called "Disability" in the statute — though the Department's current lines-of-authority list names it "Accident, Health and Sickness (often referred to as Health or Disability in other states)", so accept either on an exam item (Idaho Code § 41-1008(1)(b); Idaho DOI "Producer, Individual"; checked 2026-09-05). Second, annuities sit inside the Life line — no separate annuity line, though annuity training is separately required (Section 7).

Examination (§ 41-1006). A resident individual must pass a written examination unless exempt under § 41-1008(4) or § 41-1012. It tests the lines applied for, the duties of a producer, and the insurance laws and rules of this state. Each applicant for an examination remits a nonrefundable fee promulgated by the Director under § 41-401; the statute fixes no dollar amount, so take the current figure from the Department (Idaho Code § 41-1006(2); checked 2026-09-05). Heavily tested: applications for licensure not received by the Department within 180 days of successful completion of the examination shall be denied (Idaho Code § 41-1006(4); checked 2026-09-05).

Application (§ 41-1007). Filed on the uniform application under penalty of refusal, suspension or revocation. The Director must find the applicant is at least 18; has submitted fingerprints as required; has committed no act that is a ground for denial, suspension or revocation; has paid the fees prescribed by the Director pursuant to § 41-401 (Idaho Code § 41-1007(1)(d); checked 2026-09-05); and has passed the examinations for the lines applied for. Note what is absent: Idaho's licensing statute imposes no pre-license classroom-hour requirement for the major lines — the gate is age, fingerprints, fees and the exam. (For limited lines, an insurer-supplied program of instruction, approved by the Director, may be administered in place of the examination; Idaho's limited lines are credit — including GAP — pet and travel, and residents applying for them submit the attestation from the Department's Limited Lines Producer Pre-Licensing Manual in lieu of testing.) (Idaho Code § 41-1007(4); Idaho DOI "Producer, Individual"; checked 2026-09-05) Business entities must be licensed on the uniform business entity application and must designate a licensed individual producer responsible for compliance. On refusal (§ 41-1011) the Director notifies the applicant and any appointing insurer and states the grounds. Producers must notify the Director in writing before using an assumed name (§ 41-1014) and must inform the Director of a change of address within 30 days of the change (Idaho Code § 41-1008(6); checked 2026-09-05).

Nonresident and reciprocity. A nonresident license issues if the applicant is currently licensed and in good standing in the home state, has paid fees and filed the home-state or uniform application plus any required fingerprints, and comes from a state that licenses Idahoans on the same basis (§§ 41-1009, 41-1020); § 41-1010 covers service of process. No examination is required of an applicant currently licensed elsewhere for the same lines, or one applying within 90 days of cancellation with home-state certification of good standing; a producer licensed elsewhere who moves to Idaho must apply within 90 days of establishing legal residence (Idaho Code § 41-1012(1)(b), (2); checked 2026-09-05).

Temporary licensing (§ 41-1015). The Director may issue a temporary license without examination for a period not to exceed 180 days (Idaho Code § 41-1015(1); checked 2026-09-05) to the surviving spouse or court-appointed personal representative of a producer who dies or becomes disabled, to a member or employee of a licensed business entity on the death or disability of its designated individual, to the designee of a producer entering active military service, or where the public interest is best served. The Director may limit authority, require a sponsor who assumes responsibility, and revoke without a prior hearing if the public is endangered.

Continuation (§ 41-1013). Licenses continue until expired, suspended, revoked or terminated, subject to the continuation fee plus a written request and a continuing education statement; a renewal is not complete without both, and absent timely filing the license expires at midnight on the expiration date. Fees are earned when paid. The statute sets no term — § 41-1013(2) lets the Director fix expiration dates — and the Department's current practice is a two-year term, expiring the last day of the licensee's birth month, renewed through NIPR after CE is completed and posted. CE completion alone does not renew, and there is no grace period for renewal (Idaho Code § 41-1013(1)–(4); Idaho DOI "Producer, Individual"; checked 2026-09-05).

The lapse ladder (§ 41-1013(7)) — memorize it. Within 90 days of expiration: reinstate with proof of education plus a penalty of $100 (1–30 days), $200 (31–60), $300 (61–90) (Idaho Code § 41-1013(7); checked 2026-09-05). Day 91 to one year: complete all requirements including retesting, file a new application, pay all new fees, and prove the education for the terminated period. One year or more: reapply and retest as a new applicant. Separately, § 41-1008(3) permits reinstatement within 12 months of the due date without examination unless retesting is required, with a penalty of double the unpaid renewal fee. Section 41-1008(4) allows the Director to waive renewal procedures, examination or sanctions for military service or long-term medical disability. Under inactive status (§ 41-1028) a licensee may not transact insurance but keeps commissions on business written while active, is exempt from CE, and still pays continuation fees; reactivation takes proof of 20 hours of continuing education earned during the 12 months prior to reactivation, or proof of retesting (Idaho Code § 41-1028; checked 2026-09-05).

Appointments and reporting. A producer shall not act as an agent of an insurer unless appointed; one not acting as an insurer's agent need not be appointed. The insurer files the notice within 15 days of contract execution or first application; the Director verifies eligibility within 30 days and reports ineligibility within 5 days (§ 41-1018). On termination (§ 41-1019) the insurer notifies the Director within 30 days whether or not the reason is a § 41-1016 ground, and mails a copy to the producer within 15 days (if the termination is for cause, by certified mail, return receipt requested, or by overnight delivery through a nationally recognized carrier). A producer reports administrative actions elsewhere within 30 days of final disposition and criminal prosecutions within 30 days of the initial pretrial hearing date (Idaho Code §§ 41-1018(2)–(3), 41-1019(1), (2), (4)(a), 41-1021; checked 2026-09-05).

Discipline (§ 41-1016). The Director may impose an administrative penalty not to exceed $1,000 and may suspend for not more than 12 months (Idaho Code § 41-1016(1); checked 2026-09-05) or revoke or refuse to issue or continue a license for causes including: materially untrue information in the application; violating any provision of Title 41, a rule, subpoena, or an order of the Director or another state's insurance director; obtaining a license by misrepresentation or fraud; misappropriating or converting money received in insurance business; misrepresenting contract terms or any material fact; conviction of a relevant crime or one evidencing dishonesty or unfitness; committing any unfair trade practice or fraud; fraudulent, coercive or dishonest practices, incompetence, untrustworthiness, or being a source of injury and loss to the public; having a license denied, suspended or revoked in another state; forgery; using notes during a licensing examination; knowingly accepting business from an unlicensed individual; and failing to comply with a child support order or pay state income tax. Three structural points: the Director acts without hearing against a nonresident license after the home state's adverse order; a business entity is reachable where an owner, officer or manager knew or should have known of a violation left unreported; and enforcement survives surrender or lapse of the license, or the person never having been licensed.

Commissions (§ 41-1017). No insurer or producer may pay commissions or valuable consideration to an unlicensed person for selling, soliciting or negotiating Idaho insurance, and no unlicensed person may accept them. Renewals and deferred commissions may be paid to a person who was duly licensed at the time of the sale — this is what lets a retired producer collect renewals. Commissions may be assigned to any person, licensed or not, unless doing so violates a specific statute, expressly including § 41-1314 (rebates). Producer fees (§ 41-1030): a retail producer must first give the consumer a written statement of services and fees the consumer signs and dates; a wholesale producer gives the retail producer a comparable statement, and the fee is itemized separately on the face of the policy. Borrowing from clients (§ 41-1325): unless the client lends professionally or is a defined immediate family member, a producer must execute a written loan agreement signed by all parties, keep a record until repayment, and obtain any release in writing.
