How to use this chapter. This is the Oklahoma-specific supplement to the shared national manuscript. The national chapters teach the concepts every U.S. license exam tests — agency, contracts, financing, valuation, fair housing, federal disclosures. This chapter teaches how Oklahoma changes, narrows, or adds to those national rules, and it is the portion the Oklahoma state exam draws from. A note on numbers (YMYL). Real estate licensing is a "your money / your livelihood" subject. Rules that are stable and knowable — whether a recovery fund exists, whether a seller-disclosure form is mandatory, whether Oklahoma taxes deed transfers — are stated here plainly and affirmatively. But specific dollar figures, clock hours, continuing-education totals, exam pass scores, and fees change. Every changeable number in this chapter is flagged "verify current with the Oklahoma Real Estate Commission (OREC)." Treat the flagged numbers as study anchors, not as gospel on closing day. The controlling authorities are the Oklahoma Real Estate License Code and Rules (Title 59 of the Oklahoma Statutes, §858-101 et seq., plus OREC's administrative rules) and the OREC website.
1. The Licensing Authority: the Oklahoma Real Estate Commission (OREC)
Real estate licensing in Oklahoma is administered by the Oklahoma Real Estate Commission (OREC). OREC is the state agency created by the Legislature to license real estate brokers and associates, to enforce the Oklahoma Real Estate License Code, to adopt rules, to investigate complaints, and to discipline licensees. When the national chapters refer generically to "the state licensing agency" or "the real estate commission," in Oklahoma that body is OREC — headquartered in Oklahoma City.
What OREC actually does, and why it matters on the exam:
- Issues and renews licenses for brokers, associate brokers, sales associates, and provisional sales associates.
- Approves pre-license and continuing-education courses and schools. No education "counts" unless the course provider is OREC-approved.
- Administers or contracts the licensing examination. Oklahoma, like most states, uses a national testing vendor to deliver the exam; the exam has a national (general) portion and an Oklahoma state-law portion. This book's national chapters serve the first; this chapter serves the second.
- Adopts the License Code Rules — the administrative regulations that fill in the statute (trust-account handling, advertising, disclosure forms, education specifics).
- Investigates and disciplines. OREC can reprimand, fine, suspend, or revoke a license, and can require additional education.
- Administers the Oklahoma Real Estate Education and Recovery Fund (see §8).
A recurring exam theme: OREC regulates the license, not private contract disputes. If a question describes two parties fighting over the meaning of a purchase contract, that is a court matter; if it describes a licensee mishandling trust money, failing to disclose, or practicing without a license, that is OREC's turf.
2. License Structure and the Entry License Name (Know This Exactly)
Oklahoma's license ladder has a feature that trips up candidates who studied generic national material: the entry-level license is not simply called "Sales Associate." A new licensee first holds a Provisional Sales Associate license.
The Oklahoma structure, from the ground up:
- Provisional Sales Associate — the entry-level license. This is what a brand-new licensee receives after completing pre-license education, passing the exam, and being sponsored by a broker. The word provisional signals that the licensee has not yet completed post-license education. A Provisional Sales Associate may perform licensed real estate activity, but only while associated with and supervised by a broker, and only until the post-license education deadline arrives.
- Sales Associate — the upgraded license. A Provisional Sales Associate becomes a full Sales Associate by completing the required post-license education before the first-year license expiration. This is the single most important Oklahoma-specific progression rule on the exam:
Provisional Sales Associate → (complete post-license education) → Sales Associate.
If the post-license education is not completed by the deadline, the provisional license lapses/cannot renew — the person cannot simply keep operating as before. (Verify the exact reinstatement path and consequences current with the Oklahoma Real Estate Commission (OREC).)
- Associate Broker / Broker — higher licenses obtained after additional experience and education. A broker may operate independently, hold the trust account, and supervise associates. A broker associate/associate broker holds broker qualifications but works under another broker. These sit above the sales-associate level and are the supervisory tier.
Exam-ready summary: In Oklahoma the ladder is Provisional Sales Associate → Sales Associate → (Associate) Broker → Broker. The entry license is the Provisional Sales Associate. Do not answer "Salesperson" — Oklahoma's term is Sales Associate, and the first credential is the Provisional Sales Associate.
3. Getting Licensed: Requirements, Pre-License and Post-License Hours, and CE
The stable, affirmatively-true requirements — the categories — are these; the numbers are flagged.
3.1 Baseline eligibility
To qualify for an Oklahoma Provisional Sales Associate license, an applicant must:
- Meet the minimum age requirement (verify the current minimum age with the Oklahoma Real Estate Commission (OREC)).
- Be a U.S. citizen or a lawfully present/admitted alien.
- Demonstrate honesty, truthfulness, reputation, and competency — OREC reviews criminal history. A prior conviction does not automatically bar licensure, but OREC evaluates it; certain recent felony or fraud-related convictions can disqualify. Applicants disclose criminal history and OREC decides.
3.2 Pre-license education (required, before the exam)
An applicant must complete an OREC-approved pre-license course in basic real estate. The required amount is 90 clock hours of basic real estate instruction — verify the current pre-license hour requirement with the Oklahoma Real Estate Commission (OREC), because hour totals and course content are periodically revised. Note also that pre-license course completion is treated as valid for a limited window (a completion certificate does not last forever before the exam must be passed) — verify the current validity window with OREC.
3.3 The licensing examination
The applicant must pass the Oklahoma real estate licensing exam, which has a national/general portion and an Oklahoma-law portion. A passing score is required on each portion. The passing score (commonly expressed as a percentage of correct answers) is a changeable figure — verify the current passing score with the Oklahoma Real Estate Commission (OREC) or its testing vendor. Candidates who fail one portion generally re-take only that portion within an allowed window.
3.4 Broker sponsorship
A license is issued only when a licensed Oklahoma broker sponsors the applicant (see §4). You may pass the exam without a broker, but the license is not active until a broker associates you.
3.5 Post-license education (the Provisional → Sales Associate step)
This is Oklahoma's signature requirement. A Provisional Sales Associate must complete post-license education before the first license period expires (post-license education cannot be taken before the original license is issued). Completing it converts the license to Sales Associate. The required amount is 45 clock hours of post-license education — verify the current post-license hour requirement and the deadline with the Oklahoma Real Estate Commission (OREC).
Affirmative rule (do not hedge this): Post-license education is mandatory and is the mechanism by which a Provisional Sales Associate becomes a full Sales Associate. Failing to complete it on time has consequences for the license.
3.6 Continuing education (CE) for renewal
After becoming a Sales Associate (and for brokers), Oklahoma requires continuing education each renewal cycle to renew. Oklahoma licenses renew on a multi-year cycle, and a set number of CE hours — including required subject areas such as an OREC-mandated "Broker Relationships Act," professional conduct/ethics, fair housing, and similar topics — must be completed each cycle. The number of CE hours, the specific mandatory topics, and the renewal-cycle length are changeable — verify all of them current with the Oklahoma Real Estate Commission (OREC). As a study anchor only (confirm before relying): Oklahoma has commonly required roughly 21 hours of CE per renewal cycle, with a portion in mandatory subjects — verify current with OREC.
4. Broker Affiliation and Supervision
Affirmative rule: In Oklahoma, a Provisional Sales Associate and a Sales Associate may only conduct licensed activity while associated with, and supervised by, a licensed broker. An associate cannot operate independently, cannot hold the brokerage trust account, and cannot be paid a real estate commission by anyone other than the sponsoring broker.
Key affiliation points the exam tests:
- The broker is responsible for the associate's licensed conduct and for supervising the associate's transactions, advertising, and handling of documents and funds.
- Compensation flows through the broker. An associate is paid by the sponsoring broker, not directly by a buyer, seller, or another broker. Paying an unlicensed person a fee for licensed activity is prohibited.
- Transferring brokers. When an associate changes brokers, OREC must be notified and the license reissued under the new broker; the associate cannot "float" unattached and keep practicing.
- The broker holds and controls the trust/escrow account (see §7); associates deliver earnest money promptly to the broker.
- Advertising must be under the broker. An associate advertises in the name of the sponsoring brokerage, not as an independent firm.
5. Oklahoma Agency Law: the Broker Relationships Act (a Real Oklahoma Difference)
Oklahoma is one of the states that statutorily replaced most of the common law of agency for real estate with a defined-duties statute — the Oklahoma Broker Relationships Act (Title 59 O.S. §858-351 et seq.). This is one of the highest-yield Oklahoma-specific topics, because it differs meaningfully from the "fiduciary agency" framework taught in generic national material.
5.1 The default posture: statutory duties, not automatic fiduciary agency
Under the Broker Relationships Act, an Oklahoma broker who works with a party provides brokerage services and owes a statutorily defined set of duties to that party without automatically becoming a full common-law fiduciary/advocate. In other words, Oklahoma law spells out exactly what a broker must do, rather than importing the traditional agent-fiduciary bundle by default. The statute sets mandatory duties the broker owes to all parties in a transaction and additional duties owed to the broker's own client when a written brokerage/agency agreement creates that relationship.
Duties a broker owes to all parties (whether or not that party is the broker's client) generally include:
- Honesty and exercise of reasonable skill and care;
- Disclosing to a buyer any known defect in the property (defects actually known to the broker);
- Keeping confidential information confidential as required;
- Accounting for money and property received;
- Complying with the License Code, fair housing, and other law;
- Timely presentation of offers and counteroffers.
Additional duties to the broker's client (created by a written agreement) add loyalty-type obligations such as advising the client and putting the client's interests first within the bounds of the law.
Exam takeaway: Do not assume Oklahoma imposes full common-law fiduciary duties by default the way generic material implies. Oklahoma is a defined statutory-duties state under the Broker Relationships Act. The written agreement is what elevates a party to "client" with the added duties.
5.2 The required broker-relationship disclosure and its timing
Affirmative rule: Oklahoma requires a written disclosure of the broker's relationship/duties. A broker must describe and disclose in writing the broker's duties and the type of relationship offered, and must obtain the party's acknowledgment.
Timing — the rule to memorize: the disclosure of the broker relationship must be made before the party signs a contract to buy, sell, lease, or exchange (i.e., before the relationship-defining agreement or the transaction contract is signed, at "first substantive contact"/before commitment, not after closing). The precise trigger language and any updated form are set by OREC rule — verify the current disclosure form and exact timing trigger with the Oklahoma Real Estate Commission (OREC), but the affirmative fact is that written broker-relationship disclosure is mandatory and must occur early, before the party is contractually committed.
5.3 Working with both parties: single-party vs. transaction/both-parties brokerage
Because Oklahoma frames the relationship around statutory duties rather than exclusive fiduciary loyalty, a broker in Oklahoma may lawfully work with both the buyer and the seller in the same transaction by providing brokerage services to both, provided the required written disclosures are made and the parties are informed. Oklahoma law contemplates a broker (or firm) providing services to more than one party without the traditional "undisclosed dual agency is illegal" trap — so long as it is disclosed in writing and the statutory duties (including confidentiality and honest dealing) are honored.
Where a single associate would otherwise be conflicted, the concept of designated brokerage (the broker designating different associates to work with each side) can be used so each party gets an associate focused on that party's interests, with the managing broker over both. Verify the current mechanics, forms, and any consent requirements for working with both parties / designated relationships with the Oklahoma Real Estate Commission (OREC).
Affirmative bottom line: Oklahoma permits a broker to serve both parties when properly disclosed; it does not treat that as automatically prohibited "dual agency." The unforgivable sin is doing it without written disclosure.
