Hawaii State Law for Life & Health Producers
cuộn ↓

Everything before this chapter is national: contract law, policy types, underwriting, riders, taxation, group benefits, health plan design. This chapter is the other half of your exam — the Hawaii-specific material tested on the Life and the Accident & Health (Accident and Sickness) producer examinations.

Two study rules before you start.

Rule one: learn the rule, then learn the number. Hawaii exam questions are overwhelmingly about whether a rule exists and what it requires, not about memorizing a fee schedule. The rules are stable and you should state them flatly: Hawaii has an Insurance Division inside the Department of Commerce and Consumer Affairs (DCCA); an Insurance Commissioner with examination and enforcement powers; an unfair-methods-of-competition and unfair-or-deceptive-acts statute, with an unfair claim settlement practices provision inside it; a life and annuity replacement law; a guaranty association; a free-look mandate; an annuity best-interest standard; and a senior-designation statute. None of those facts move. The numbers attached to them — hours, days, dollars, limits — do move. Wherever you see (verify current with the Hawaii Insurance Division (DCCA)), treat the figure as a snapshot: learn the concept, confirm the digit at cca.hawaii.gov/ins.

Rule two: Hawaii has two statutes no other state has. The Hawaii Prepaid Health Care Act (employer-mandated health coverage) and the Hawaii Temporary Disability Insurance (TDI) law (mandatory short-term disability) are unique in the United States, they are administered by the Department of Labor and Industrial Relations rather than the Insurance Division, and they are reliably tested. Section 12.11 covers them. If you skip anything in this chapter, do not skip that section.

The primary authorities are the Hawaii Revised Statutes, Chapter 431 (the Insurance Code) — with Article 9A for producer licensing, Article 10D for life insurance and annuities, Article 10A and 10H for accident and health and long-term care, Article 13 for unfair practices, and Article 16 for the guaranty association — together with Title 16 of the Hawaii Administrative Rules, administered by the Insurance Division of the DCCA.

12.1 The Hawaii Insurance Division and the Insurance Commissioner

The office

Hawaii does not have a stand-alone insurance department. Insurance is regulated by the Insurance Division, one of the divisions of the Department of Commerce and Consumer Affairs (DCCA). The Division is under the supervision and control of an administrator known as the Insurance Commissioner (HRS 431:2-102).

The single most-tested Hawaii fact about this office: the Hawaii Insurance Commissioner is appointed, not elected. The Director of Commerce and Consumer Affairs appoints the Commissioner with the approval of the Governor, the position is exempt from the civil service statute, and the Commissioner serves at the pleasure of the Director. Contrast this with states such as California that elect the office. If an exam item offers "elected by the voters of Hawaii," it is wrong.

Powers

The Commissioner has the authority expressly conferred by the Insurance Code and the authority reasonably implied from it, and must enforce the Code (HRS 431:2-201):

  • Rulemaking. Administrative rules implementing Chapter 431 live in Title 16 of the Hawaii Administrative Rules and carry the force of law.
  • Examination. Examining the books, records, accounts, transactions, and business practices of insurers and licensees — recurring financial examinations of domestic insurers, market conduct examinations as needed. The examined company generally bears the expense.
  • Investigation and hearings. Investigating suspected violations, compelling testimony and documents, holding administrative hearings. A licensee facing discipline gets notice and an opportunity to be heard.
  • Licensing control. Issue, deny, refuse to renew, suspend, revoke, or condition producer licenses — and the Commissioner may proceed even after a license has lapsed or been surrendered.
  • Cease and desist orders against unfair methods of competition and unfair or deceptive acts, plus restitution.
  • Civil fines authorized under Article 2, imposed in addition to or instead of license action. Penalty amounts: verify current with the Hawaii Insurance Division (DCCA).
  • Form oversight. Life, annuity, and health forms must be filed with and approved by the Commissioner before use.
  • Fraud enforcement. The Division houses an Insurance Fraud Investigations Branch; insurance fraud is a crime in Hawaii and matters may be referred for prosecution.
  • Consumer complaints. The Division receives, investigates, and mediates complaints against insurers and producers.

What the Commissioner does not do: decide private contract disputes, act as a policyholder's lawyer, or guarantee an insurer's solvency. A consumer's damages claim is a civil-court matter; the Division's leverage is regulatory.

12.2 Producer licensing in Hawaii

Hawaii uses the NAIC "producer" vocabulary. A license grants lines of authority — here, Life and Accident and Health or Sickness. Most life and health producers hold both. Variable life and variable annuities also require FINRA registration and a variable products qualification; a life line alone does not authorize variable sales.

No person may sell, solicit, or negotiate insurance in Hawaii without a license (HRS 431:9A-103). "Sell," "solicit," and "negotiate" are defined terms — memorize the trio, because unlicensed solicitation violates the law even if no policy is ever sold.

Resident license requirements

To obtain a resident Life or Accident & Health producer license you must:

  1. Meet the minimum age and be a Hawaii resident (or maintain your principal place of business in Hawaii).
  2. Pass the Hawaii licensing examination for each line of authority (HRS 431:9A-105). Hawaii's examinations are administered by Pearson VUE, at test centers and by online proctoring. Exam fee per line, question count, time limit, passing score, retake wait, and how long a passing score stays valid: verify current with the Hawaii Insurance Division (DCCA). (Historically: a per-line fee, a 70 passing score, a 24-hour retake wait, no cap on retakes.)
  3. Understand Hawaii's prelicensing education posture. Hawaii does not impose a formal statutory prelicensing course-hour requirement for the life and health lines — the gate is the examination itself. Commercial prep is optional, not a state mandate. Confirm the current position with the DCCA; this is exactly the kind of rule a legislature can add.
  4. Submit fingerprints for a criminal history record check through the state's designated vendor. Fingerprint fee: verify current with the DCCA.
  5. File the application and pay the fee, ordinarily electronically through NIPR. Application and license fees: verify current with the DCCA.

Sequencing trap: passing the exam does not license you. The license issues only after the application is filed, the background check clears, and the Commissioner approves. You may not solicit in the interim.

An applicant previously licensed for the same lines of authority in another state need not complete prelicensing education or the Hawaii examination if the application is received within a defined window after cancellation of the prior license and the prior state issues a letter of clearance. The window (historically ninety days): verify current with the DCCA.

Term, renewal, and continuing education

Hawaii producer licenses run on a two-year (biennial) cycle keyed to the licensee's birth month: the license expires on the last day of the licensee's birth month, in even-numbered years for producers born in even-numbered months and odd-numbered years for producers born in odd-numbered months. Learn the structure — it is the most commonly missed Hawaii licensing item, because most states use a flat calendar date.

Continuing education must be completed before the renewal application is submitted, from Commissioner-approved providers and approved courses. Article 9A defines a "credit hour" as the value assigned to an approved course equivalent to at least fifty minutes of classroom instruction — a definition Hawaii writes into the statute itself.

The CE structure to learn:

  • A total credit-hour requirement per two-year term that includes a mandatory ethics or Hawaii insurance law sub-requirement. Both figures: verify current with the DCCA (historically 24 total credit hours including 3 hours of ethics or law, with a split allocation for producers holding both life/health and property/casualty authority).
  • No carryover of excess hours between terms, and no repeat credit for the same course within a term.
  • Annuity training. A producer may not sell, solicit, or negotiate annuities in Hawaii until completing a one-time, state-approved annuity best-interest training course, and this applies to residents and nonresidents alike. Course length (historically four credit hours) and any refresher: verify current with the DCCA.
  • Long-term care training — an initial course plus ongoing training — for producers selling LTC. Hours: verify current with the DCCA.
  • Exemptions exist for certain limited-line licensees and for producers licensed less than a full term at first renewal. Verify the criteria with the DCCA.
  • Reactivation. A licensee applying to reactivate a line of authority must satisfy that line's CE before reactivation.

Failure to complete CE means the license is not renewed, and you may not transact while it is lapsed. Reinstatement and late-renewal paths exist, with added fees and deadlines — verify the current windows and late fees with the DCCA.

Temporary and nonresident licenses

Hawaii authorizes temporary licensing (HRS 431:9A-111) so in-force business is not stranded when a producer dies, becomes disabled, or is called to active military service. A temporary license may go to the surviving spouse, a court-appointed personal representative, an employee, or another designee, to service and wind down the existing book; it is limited in duration and scope, and the Commissioner may impose conditions or require a sponsoring producer. Maximum duration: verify current with the DCCA. It is not a shortcut into the business for someone who has not passed the exam.

Hawaii issues nonresident licenses on a reciprocity basis: a producer licensed and in good standing in the home state may be licensed without the Hawaii examination where the home state reciprocates. Nonresidents must keep the home-state license in force — if it lapses or is revoked, the Hawaii license falls with it — and must comply with Hawaii conduct rules, including Hawaii's annuity best-interest training requirement, which Hawaii applies to nonresidents.

Grounds for denial, nonrenewal, suspension, and revocation

HRS 431:9A-112 lists the grounds. Recognize all of them:

  • Providing incorrect, misleading, incomplete, or materially untrue information in a license application.
  • Violating any insurance law, rule, subpoena, or order of the Commissioner or of another state's regulator.
  • Obtaining or attempting to obtain a license through misrepresentation or fraud.
  • Improperly withholding, misappropriating, or converting money or property received in the course of insurance business — premium theft is the classic case; premium funds are held in a fiduciary capacity.
  • Intentionally misrepresenting the terms of an actual or proposed contract or application.
  • Conviction of a felony.
  • Having admitted to or been found to have committed insurance unfair trade practices or fraud.
  • Fraudulent, coercive, or dishonest practices, or incompetence, untrustworthiness, or financial irresponsibility, in Hawaii or elsewhere.
  • Having a license denied, suspended, or revoked in any other state, province, district, or territory.
  • Forging a name to an application or any insurance document.
  • Cheating on a licensing examination, including improperly using notes or reference material.
  • Knowingly accepting insurance business from an unlicensed person.
  • Failing to comply with a child support order, or with an order directing payment of state or federal income tax; knowingly failing to pay state income tax.

The Commissioner may also impose a civil fine in addition to or instead of license action, and may proceed even if the license has lapsed or been surrendered.

Reporting duties. A producer must report any administrative action by another jurisdiction or governmental agency and any criminal prosecution in any jurisdiction, with copies of the documents, and must report changes of legal name, residence, mailing address, business address, and email. Reporting deadlines: verify current with the DCCA. These duties are affirmative and self-executing — nobody prompts you. Note the federal overlay: under 18 U.S.C. 1033, a person convicted of a felony involving dishonesty or breach of trust may not engage in the business of insurance affecting interstate commerce without written consent (a 1033 waiver), obtained in Hawaii through the Commissioner.

12.3 Appointments

A Hawaii producer transacting business for an insurer must be appointed by that insurer (HRS 431:9A-114). The insurer files the appointment, not the producer, and pays the fee. Appointment is per-insurer: holding a license does not authorize you to write for a company that has not appointed you, and a producer may hold appointments from many insurers. When the relationship ends, the insurer must notify the Commissioner of the termination (HRS 431:9A-115), and if the termination was for cause — a reason listed in HRS 431:9A-112, or conduct the insurer believes violated the Code — it must report the reason. Hawaii grants the reporting insurer immunity for good-faith statements, and the report is confidential, not a public record; the producer is entitled to notice and an opportunity to respond. Appointment fees and filing deadlines: verify current with the Hawaii Insurance Division (DCCA).

Exam trap: holding yourself out as an independent broker when you are in fact an appointed agent of one insurer is a misrepresentation, independent of the appointment rules.
