We didn't give you the easy intro — the free chapter opens on one of the hardest-working parts of the book, so you can judge the teaching where the exam gets difficult.
This chapter covers the Kentucky-specific law you must know to pass the state portion of the Kentucky Life & Health Insurance examination and to practice legally in the Commonwealth. It supplements — it does not replace — the national chapters. Where the two overlap, the Kentucky rule controls inside Kentucky.
How to read the flagged numbers. The existence of a rule — a guaranty association, a replacement regulation, an unfair-trade-practices act, a replacement refund right, a CE mandate — is stable, and this chapter states those affirmatively. Where a commonly taught rule rests on a weaker footing than students assume — Kentucky's general free look is the example (Section 5) — this chapter says so rather than dressing it up as a mandate. The figures attached to them — fees, CE hours, free-look days, filing windows, penalties, guaranty caps — are set by statute, regulation, or fee schedule and can change. Every such number is marked "verify current with the Kentucky Department of Insurance (DOI)." Primary authorities. The Kentucky Department of Insurance (insurance.ky.gov), the Kentucky Insurance Code at KRS Chapter 304, and the department's regulations at Title 806 KAR. Licensing is KRS Subtitle 304.9; trade practices 304.12; life and annuity contracts 304.15; the guaranty association 304.42.
1. The Kentucky Department of Insurance and the Commissioner
Insurance in Kentucky is regulated by the Kentucky Department of Insurance, which sits within the Public Protection Cabinet. Its chief officer is the Commissioner of Insurance.
Appointment, not election. Under KRS 304.2-020 the Commissioner is appointed by the Governor with the consent of the Senate, on the basis of merit and fitness, for a term not to exceed four years, and may be reappointed. If the Senate is not in session, the appointment takes effect at once subject to later approval. Kentucky does not elect its insurance regulator. The statute also establishes the department's divisions, headed by directors appointed by the cabinet secretary. Verify the current term and structure with the DOI.
A naming quirk. From roughly 2004 to 2010 the agency was the Office of Insurance and its head the Executive Director of Insurance. Much surviving statutory and regulatory text still says "executive director." Read those as "Commissioner" and "Department of Insurance."
Powers and duties.
- Licensing — issues, renews, places on probation, suspends, revokes, and refuses licenses of agents, consultants, adjusters, administrators, and business entities; admits insurers.
- Rulemaking — promulgates regulations under Title 806 KAR and issues advisory opinions and bulletins, frequently adopting NAIC model language (replacement, annuity suitability, annuity and life disclosure, privacy).
- Examination and investigation — examines the financial condition and market conduct of insurers, investigates licensees and unlicensed activity, and may compel records, subpoena witnesses, and administer oaths. Licensees must respond to departmental inquiries; failing to is exposure under KRS 304.9-440.
- Enforcement — holds hearings, issues desist (cease-and-desist) orders under KRS 304.12-120, reaches undefined unfair practices under KRS 304.12-130, and imposes civil penalties under KRS 304.99-020 and KRS 304.2-140. Verify current penalty amounts with the DOI.
- Consumer protection and solvency — investigates complaints; pursues rehabilitation, conservation, or liquidation of impaired insurers, coordinating with the guaranty association (Section 6).
Adverse licensing actions carry notice and an opportunity for a hearing (KRS 304.9-450, 304.9-465), with final orders subject to judicial review. Verify current deadlines with the DOI.
2. Producer Licensing in Kentucky
Kentucky says "agent." The subtitle is titled Agents, Consultants, Solicitors and Adjusters (KRS Subtitle 304.9), the available licenses are insurance agent licenses (KRS 304.9-030), and KRS 304.9-020 defines an agent as one who sells, solicits, or negotiates insurance. On a Kentucky question, "agent" is the statutory term. Kentucky also licenses business entities (KRS 304.9-130) with designated individuals responsible for compliance (KRS 304.9-133).
Kentucky also licenses "consultants" — a genuinely Kentucky feature. A consultant (KRS 304.9-040, qualifications at 304.9-320) advises on insurance for a fee rather than commission, must file proof of liability (E&O) insurance (KRS 304.9-330), and owes an express obligation to serve the interest of the client (KRS 304.9-360). KRS 304.9-350 governs compensation of an agent operating under a disclosure agreement.
Resident license requirements.
- Meet the age and residency requirements of KRS 304.9-120 (which contains a narrow residency exception). Verify the current minimum age with the DOI.
- Be competent, trustworthy, and of good personal and business reputation under the general qualifications of KRS 304.9-105.
- Complete approved prelicensing education. Kentucky does mandate it. KRS 304.9-105 directs the Commissioner to set it and 806 KAR 9:025 implements it: a prelicensing course is required for each line of authority requested, so a life-and-health applicant completes both the life and the health course. Completion is valid only for a limited time before it goes stale. Verify the current hour counts and validity window with the DOI. KRS 304.9-170 lists exemptions; variable products and most limited lines fall outside the standard mandate.
- Pass the Kentucky examination for each line (KRS 304.9-160, -180, -190) at the minimum percentage set by 806 KAR 9:025. Verify the current passing score and fee with the DOI.
- File the NAIC uniform individual application, ordinarily through NIPR, with proof of prelicensing.
- Submit a criminal background check — Kentucky's resident check runs through the Administrative Office of the Courts (AOC), a Kentucky-specific step; KRS 304.9-270 also ties a background check to appointment. Verify the current vendor and fee with the DOI.
- Pay the fees set by 806 KAR 4:010. Verify current amounts with the DOI.
Controlled business. KRS 304.9-100 restricts "controlled business" — a license may not be obtained principally to write coverage on the licensee, family, or the licensee's own business interests. Kentucky sets a percentage threshold; verify it with the DOI.
Lines of authority. KRS 304.9-030 lists life, health, variable life and variable annuity products, property, casualty, personal lines, and limited lines (credit, crop, travel, rental vehicle, portable electronics, self-service storage). Variable products are also securities — beyond the Kentucky variable line, the seller needs FINRA registration (SIE plus Series 6 or 7) and a broker-dealer affiliation.
Appointment. A license permits a person to act; an appointment authorizes representing a specific insurer. Under KRS 304.9-270 an insurer files the appointment with the Commissioner within a window set by 806 KAR 9:025. KRS 304.9-035 makes the insurer liable for the acts of its agents and adjusters. Terminations are filed under KRS 304.9-280, stating the cause where for cause; KRS 304.9-290 preserves the agent's rights, including renewal commissions on business written while appointed. KRS 304.9-436 bars an authorized insurer from doing business in Kentucky with an unlicensed person. Verify current windows and fees with the DOI.
Continuation, renewal, and CE. Under KRS 304.9-260 a Kentucky agent license continues in effect so long as the renewal fee is paid and CE is satisfied; otherwise it expires.
- Renewal is biennial and keyed to the licensee's birth month — the compliance period ends the last day of the birth month, in an odd- or even-numbered year determined by year of birth. Never assume a calendar-year deadline. Verify your date with the DOI.
- CE is mandatory. KRS 304.9-295 imposes biennial continuing education including a mandatory ethics component, with a minimum number of hours in the line held. Hours may be classroom, correspondence, or self-study, and a given course counts once per biennium. Every hour figure is changeable — verify current with the DOI.
- Carryover of excess hours into the next period is allowed, credited as general hours only — carryover never satisfies ethics. Verify the current cap with the DOI.
- Holding multiple licenses does not double the hours; one set of hours credits both.
- Exemptions — limited lines such as credit, crop, and travel (KRS 304.9-230). Verify the current list.
- Product-specific training layers on top: a one-time annuity course (Section 7), long-term care initial and ongoing training, and NFIP flood training. Verify all current hours with the DOI.
- Missing CE terminates the license. Kentucky then allows a reinstatement window to complete delinquent hours and reinstate without re-examination; after it closes, the applicant starts over with prelicensing and the exam. Verify the current window and any penalty with the DOI.
Ongoing duties. Report address changes (KRS 304.9-200), other states' administrative actions, and criminal prosecutions; notify the Commissioner on surrender or termination of a license (KRS 304.9-467); maintain a place of business, display licenses, and keep records (KRS 304.9-390). Verify current reporting windows with the DOI.
Temporary licenses. Kentucky does authorize them. KRS 304.9-300 ("Temporary license as agent — Conditions — Sponsor may be required") permits issuance without the usual examination — classically to the surviving spouse, personal representative, or designee of a deceased or disabled agent, to the designee of an agent entering military service, and to keep an agency in transition operating. KRS 304.9-310 sets rights and limitations. The Commissioner may require a sponsoring agent or insurer to assume responsibility, limit the authority, and revoke. The department has also used temporary resident licenses as a transitional path for new applicants. Verify current duration and eligibility with the DOI.
Nonresident licenses. KRS 304.9-140 provides reciprocal nonresident licensing: a producer licensed and in good standing in the home state may obtain a Kentucky nonresident license for the same lines without Kentucky prelicensing or examination, on application (typically NIPR) and fee. CE is satisfied through home-state compliance. A Kentucky resident who moves must license in the new home state and convert Kentucky to nonresident. KRS 304.9-370 governs service of process. Verify current fees with the DOI.
Grounds for discipline — KRS 304.9-440, heavily tested. The Commissioner may place on probation, suspend, impose conditions, revoke, or refuse to issue or renew, and/or levy a civil penalty under KRS 304.99-020, in any combination, for causes including: incorrect, misleading, incomplete, or materially untrue information in an application; violating any insurance law, regulation, subpoena, or order (Kentucky's or another state's); obtaining a license by misrepresentation or fraud; improperly withholding, misappropriating, or converting money received in the insurance business; intentionally misrepresenting contract terms; felony conviction; committing unfair trade practices or fraud; fraudulent, coercive, or dishonest practices or incompetence, untrustworthiness, or financial irresponsibility; license denial, suspension, or revocation in another state; forgery; cheating on a licensing exam; knowingly accepting business from an unlicensed person; failing to comply with a child support order; failing to pay state income tax; and failing to respond to an inquiry from the Commissioner.
Kentucky nuance for business entities: the entity's license is at risk for a designee's violation where a partner, officer, or manager knew or should have known and the violation was neither reported nor corrected. Suspensions and conditional continuances are capped at a maximum number of months. Verify the cap, penalty amounts, and inquiry-response window with the DOI.
Independently, 18 U.S.C. 1033–1034 bars anyone convicted of a felony involving dishonesty or breach of trust from the business of insurance without written consent from the state regulator (a "1033 waiver"), which Kentucky processes.
3. Marketing, Sales Conduct, and Kentucky's Unfair Trade Practices Law
Kentucky has an unfair-trade-practices law: KRS Subtitle 304.12, "Trade Practices and Frauds." KRS 304.12-010 prohibits unfair competition and unfair or deceptive acts; KRS 304.12-013 adds prohibited practices in the writing of insurance. Kentucky then gives each classic offense its own section number, which makes it easy to study:
- Misrepresentation and false advertising — KRS 304.12-020 ("Advertisements in general"): any estimate, illustration, circular, statement, sales presentation, omission, or comparison misrepresenting the benefits, advantages, conditions, or terms of a policy; misrepresenting dividends or an insurer's financial condition; using a policy name or title that misrepresents its nature; presenting a policy as shares of stock. Related: -050 (advertising of assets and liabilities), -200 (deceptive use of an insurer's name).
- Twisting — KRS 304.12-030, "Replacement life insurance — 'Twisting' prohibited." Kentucky names it in the statute title. Twisting is using misrepresentation or incomplete or misleading comparisons to induce an owner to lapse, forfeit, surrender, terminate, retain, or convert a policy or annuity, or take a new one, to the owner's disadvantage. This section is also the authority for the replacement regulation — memorize KRS 304.12-030 → 806 KAR 12:080.
- Churning — funding a new policy from an existing policy's values, typically with the same insurer, without proper disclosure. Kentucky reaches it through the misrepresentation, twisting, and replacement rules.
- False financial statements — KRS 304.12-040.
- Defamation — KRS 304.12-060: a false, maliciously critical, or derogatory statement calculated to injure a person in the business of insurance or an insurer's financial condition.
- Boycott, coercion, and intimidation — KRS 304.12-070, where it results in or tends to result in restraint of trade or monopoly.
- Unfair discrimination — KRS 304.12-080, with -085 (race, color, religion, national origin, sex), -211 (domestic violence and abuse may not be a reason to limit or deny coverage), -215 (blindness), and -087, the Living Donor Protection Act of 2021, barring discrimination in life, disability, and LTC insurance against living organ donors — a distinctly Kentucky item.
- Rebating — KRS 304.12-090, "Rebates prohibited": paying, allowing, or giving, directly or indirectly, any rebate of premium, special favor in dividends or benefits, or any valuable consideration or inducement not specified in the policy. KRS 304.12-110 adds illegal inducements.
- Permitted exceptions. KRS 304.12-100 sets out exceptions to the rebate and discrimination bans. KRS 304.12-092, "Gifts, sweepstakes, and drawings — When permitted," expressly allows certain promotions subject to conditions including a value cap and a rule that participation not be contingent on buying insurance. The cap and conditions are changeable — verify current with the DOI before giving anything of value. KRS 304.12-112 separately prohibits advertising, offering, or providing free insurance as an inducement.
- Illegal dealing in premiums — KRS 304.12-190, read with KRS 304.9-400: premiums are held in a fiduciary capacity, never commingled, and remitted promptly.
- Coercion and free choice — KRS 304.12-140 (coercion in requiring insurance), -150 (notice of free choice of agent or insurer), -160 (certain loan-related insurance fees).
- Beneficiaries' Bill of Rights — KRS 304.12-035, a Kentucky-specific protection governing dealings with life insurance beneficiaries.
Unfair claims settlement practices. Kentucky has them, at KRS 304.12-230. Conduct is a violation when committed in conscious disregard of the statute or regulations or with such frequency as to indicate a general business practice — a single honest mistake generally is not; a flagrant act or a pattern is. Prohibited conduct includes misrepresenting pertinent facts or policy provisions; failing to acknowledge and act reasonably promptly on claim communications; failing to adopt reasonable standards for prompt investigation; refusing to pay without a reasonable investigation; failing to affirm or deny coverage within a reasonable time after proofs of loss; failing to attempt in good faith a prompt, fair, and equitable settlement where liability is reasonably clear; compelling insureds to litigate by offering substantially less than amounts ultimately recovered; and failing to give a reasonable explanation for a denial or compromise offer. KRS 304.12-220 defines terms, KRS 304.12-235 sets time of payment of claims, and 806 KAR 12:095 implements the standards on the property-casualty side. Kentucky courts also recognize a private right of action under this statute in appropriate cases. Verify current payment deadlines with the DOI.
Advertising and disclosure. 806 KAR 12:170, "Life insurance disclosures," requires delivery of the current NAIC Life Insurance Buyer's Guide and a policy summary with individual life solicitations (excluding annuities, credit life, group life, ERISA plans, and variable life). 806 KAR 12:150, "Annuity disclosures," requires an Annuity Buyer's Guide and a disclosure document. Advertising must be truthful and not misleading in fact or by implication, must not obscure limitations and exclusions, and the insurer is responsible for all advertisements of its policies regardless of who created or distributed them — including agent-created material and social media. Insurers keep an advertising file.
Commissions and unlicensed persons. KRS 304.9-421 (sharing of commissions) and KRS 304.9-425 (payment or acceptance of commission, brokerage, or other valuable consideration): commission may be paid only to a person properly licensed and, where required, appointed for the line involved, and shared only with another appropriately licensed person. Paying an unlicensed person to sell, solicit, or negotiate insurance is prohibited, and knowingly accepting business from one is a KRS 304.9-440 ground.

Is a study guide enough for the Kentucky Life & Health Insurance Producer Exam, or do I need a course?

For the exam content itself, this 98-page guide teaches the material chapter by chapter with 50 practice questions and explanations inside, and 412 more practice questions are free on PrepPass. A prep course adds live instruction and a set schedule; whether you need one beyond any required education is your call.

Who administers the Kentucky Life and Health Insurance Agent License Examinations?
Kentucky Department of Insurance. The Department runs the exams itself, with no outside testing vendor: candidates book through a Department eServices account after their application is processed, and sit a computerized exam at the Department in Frankfort or at a community or technical college site. Walk-ins are not accepted. Resident agent applicants must first complete a 20-hour pre-licensing classroom or self-study course for the lines of authority requested.
How many questions are on the Kentucky Life and Health Insurance Agent License Examinations?
There is no combined Life & Health exam; the regulation requires a life examination for the life line and a health examination for the health line. The Department's study outlines give each exam 50 questions: Life has 3 questions on Kentucky law, Health has 4.
How long is the Kentucky Life and Health Insurance Agent License Examinations?
Not published by Kentucky Department of Insurance. No time limit for the Life or Health exam is printed. The only durations the Department publishes are for consultant exams, and they disagree: the Testing Sites page says 150 questions in 190 minutes, while the schedule document says the consultant exam takes 3 hours.
What is the passing score for the Kentucky Life and Health Insurance Agent License Examinations?
70%. The regulation requires an applicant to "answer correctly seventy (70) percent of the questions". The Department's schedule says an applicant may test an unlimited number of times within the 120-day window of the application, with a $50 fee for each scheduled retake; a failed exam cannot be rescheduled for the same day.
How much does the Kentucky Life and Health Insurance Agent License Examinations cost?
$50 — Examination fee, per exam (Life or Health), including each retake (Kentucky Department of Insurance, per attempt); $40 — Resident individual agent licence (Kentucky Department of Insurance, one-time); $40 — Each line of authority on that licence (Life and Health are separate lines) (Kentucky Department of Insurance, one-time). All three amounts are set in 806 KAR 4:010 and match the Department's Fee Summary. The exam fee is charged per exam, so Life and Health are $50 each. The criminal background report ordered through the Administrative Office of the Courts is paid separately and its fee is not printed in these sources.
What languages is the Kentucky Life and Health Insurance Agent License Examinations offered in?
Not published by Kentucky Department of Insurance. None of the Department's exam pages, schedule or study outlines states the language of the Life or Health exam or mentions a non-English form.
